Ang isa sa mga BFF ko na nagtatrabaho sa department store ang pinagsisigawan ng foreigner na ina-assist niya. Marami itong sinabing masasakit na salita, tulad ng “You are f***ing retarded!”, “You should go to hell, you moron!” at “You’re so stupid!” Sobrang naiyak ang kaibigan ko dahil sa kahihiyan na marami ang nakarinig. Sa ngayon nga ay may trauma pa rin siya. Mabuti na lamang at binigyan muna siya ng kanyang pinagtatrabahuan ng ilang araw para lumiban sa trabaho. Iniisip ngayon ng kaibigan ko na magreklamo laban sa foreigner at nais sana niya na hindi muna makaalis ito upang harapin ang reklamo. May paraan ba? – Geno


Dear Geno,

Sa ilalim ng ating Revised Penal Code (RPC), itinuturing na krimen ang pagsasalita ng mga maaaring makasira sa reputasyon o puri ng tao:


“Section 94. Article 358 of the same Act is hereby amended to read as follows:


Art. 358. Slander. — Oral defamation shall be punished by arresto mayor in its maximum period to prisión correccional in its minimum period if it is of a serious and insulting nature; otherwise the penalty shall be arresto menor or a fine not exceeding Twenty thousand pesos (₱20,000).” (Republic Act No. 10951)


Kung maghahain ng reklamo ang kaibigan ninyo laban sa banyagang nagpahiya sa kanya sa harap ng ibang tao sa pamamagitan ng pagsasabi ng mga masasakit na salita, maaari siyang mag-mosyon upang magpalabas ang hukuman ng kautusan upang hindi makaalis ng bansa ang huli upang maharap nito ang reklamong kriminal. Alinsunod sa A.M. 18-07-05-SC o ang Proposed Rule on Precautionary Hold Departure Order na inaprubahan ng ating Korte Suprema, maaaring hilingin sa hukuman na hindi paalisin ang isang banyagang inirereklamo kung preliminaryong nakakitaan ng Piskalya ng probable cause ang reklamo:


“SECTION 1. Precautionary Hold Departure Order. — is an order in writing issued by a court commanding the Bureau of Immigration to prevent any attempt by a person suspected of a crime to depart from the Philippines, which shall be issued ex-parte in cases involving crimes where the minimum of the penalty prescribed by law is at least six (6) years and one (1) day or when the offender is a foreigner regardless of the imposable penalty.x x x


SECTION 3. Finding of Probable Cause. — Upon motion by the complainant in a criminal complaint filed before the office of the city or provincial prosecutor, and upon a preliminary determination of probable cause based on the complaint and attachments, the investigating prosecutor may file an application in the name of the People of the Philippines for a precautionary hold departure order (PHDO) with the proper regional trial court. The application shall be accompanied by the complaint-affidavit and its attachments, personal details, passport number and a photograph of the respondent, if available.”


Sana ay nabigyan namin ng linaw ang inyong katanungan. Ang payong aming ibinigay ay base lamang sa impormasyon na inyong inilahad at maaaring magbago kung mababawasan o madaragdagan ang mga detalye ng inyong salaysay.
