Adoptive parent na solo parent

Dear Chief Acosta,

 

Ako at ang aking asawa ay legal na nag-ampon ng isang bata noong taong 2018. Sa kasamaang palad, nawala na ang aking asawa noong nakaraang taon kaya naman ako na ang tumatayong solo parent para sa aming anak.


Maaari ko bang makuha ang mga pribilehiyo ng isang solo parent na ibinibigay ng ating batas kahit na ako ay isang adoptive mother lamang? -- Ana

 

Dear Ana, 

 

Para sa iyong kaalaman, ang probisyon ng batas na nakasasaklaw sa iyong katanungan ay ang Section 4 ng Republic Act (R.A.) No. 11861 o mas kilala sa tawag na Expanded Solo Parents Welfare Act, kung saan nakasaad na:

 

“Section 4. Section 4 of Republic Act No. 8972 is hereby repealed and a new provision is inserted to read as follows:

 

“Section 4. Categories of Solo Parent. – A solo parent refers to any individual who falls under any of the following categories: x x x

 

(d) Any legal guardian, adoptive or foster parent who solely provides parental care and support to a child or children;”  

 

Kaugnay nito, nakasaad din sa Section 6 (c) ng Revised Implementing Rules and Regulations (RIRR) ng Republic Act No. 8972 (R.A. No. 8972) or the “Solo Parents Welfare Act of 2000” as Amended by Republic Act No. 11861 (R.A. No. 11861) or the “Expanded Solo Parents Welfare Act” ang sumusunod: 

 

“c. Adoptive parent” - refers to a person who, through adoption, is considered the legitimate parent of a child over whom he/she has parental authority. In order for an individual to become an adoptive parent, he/she must complete all the legal requirements and must have been decreed as qualified to adopt a child by the court, pursuant to Republic Act No. 8552 (R.A. No. 8552) or the “Domestic Adoption Act of 1998”; or by the National Authority for Child Care (NACC), pursuant to Republic Act No. 11642 (R.A. No. 11642) or the Domestic Alternative Adoption and Alternative Child Care Act;”

 

Malinaw sa nakasaad na batas na ang mga adoptive parents ay kabilang sa mga kinokonsiderang solo parents, basta’t legal nilang inampon ang kanilang anak, at solo nilang tinataguyod, sinusuportahan, at inaalagaan ang kanilang mga anak.

 

Sana ay nabigyan namin ng linaw ang iyong katanungan. Ang payong aming ibinigay ay base lamang sa mga impormasyon na iyong inilahad at maaaring magbago kung mababawasan o madaragdagan ang mga detalye ng iyong salaysay.
