Halaga ng uniporme, bawal ikaltas sa sahod ng empleyado

Dear Chief Acosta, Inaalok ng trabaho ang kapatid ko sa pribadong kumpanya pero sinabi sa kanyang ibabawas daw sa sahod niya ang gagamitin niyang uniporme. Tama ba ‘yun? - Franz
Dear Franz, Alinsunod sa ating Labor Code, hindi maaaring makialam ang employer sa paggamit ng manggagawa sa kanyang sahod. Kabilang na rito ang pagbawas o pagkaltas sa sahod ng pribadong manggagawa para sa kanyang uniporme. Partikular na nakasaad sa Labor Code ang mga probisyong ito:
“ART. 112. Non-interference in disposal of wages. - No employer shall limit or otherwise interfere with the freedom of any employee to dispose of his wages. He shall not in any manner force, compel, or oblige his employees to purchase merchandise, commodities or other property from any other person, or otherwise make use of any store or services of such employer or any other person.
ART. 113. Wage deduction. - No employer, in his own behalf or in behalf of any person, shall make any deduction from the wages of his employees, except:
(a) In cases where the worker is insured with his consent by the employer, and the deduction is to recompense the employer for the amount paid by him as premium on the insurance;
(b) For union dues, in cases where the right of the worker or his union to check-off has been recognized by the employer or authorized in writing by the individual worker concerned; and
(c) In cases where the employer is authorized by law or regulations issued by the Secretary of Labor and Employment.”
Maliban dito, nakasaad din sa Labor Advisory No. 11, Series of 2014 ng Department of Labor and Employment na:
“7. Unauthorized Deductions. – Deductions made from the employees’ wages for company uniforms, cash deposits for loss or damages, personal protective equipment (PPE), x x x and other deductions not included in the enumeration above, are unauthorized.”
Samakatwid, kung tatanggapin ng kapatid mo ang trabaho na inalok sa kanya at siya naman ay kukunin ng naturang kumpanya ay hindi dapat ibawas sa kanyang sasahurin ang halaga ng uniporme na gagamitin niya para sa kanyang trabaho.
Nawa ay nasagot namin ang inyong mga katanungan. Nais naming ipaalala sa inyo na ang opinyong ito ay nakabase sa inyong mga naisalaysay sa inyong liham at sa pagkakaintindi namin dito. Maaaring maiba ang opinyon kung mayroong karagdagang impormasyong ibibigay. Mas mainam kung personal kayong sasangguni sa isang abogado.
