Sa panahon ng kalamidad… Pay rules sa suspensyon ng trabaho, inilabas ng DOLE

Naglabas ang Department of Labor and Employment (DOLE) ng mga panuntunan hinggil sa pagbabayad ng sahod o payment of wages para sa mga empleyado na magre-report sa trabaho sa panahon ng weather disturbances.


Sa isang statement na inisyu ngayong Huwebes, ayon sa ahensiya, ang Labor Advisory No. 17, series of 2022 ay inisyu ni DOLE Secretary Bienvenido Laguesma kung saan nakasaad, “to guide private sector employers on the suspension of work and the appropriate payment of wages during inclement weather conditions and calamities.”


Sa isang advisory, sinabi ni Laguesma na ang mga employers ng pribadong sektor ay may prerogative na magsuspende ng trabaho para matiyak ang kaligtasan at kalusugan ng kanilang mga empleyado.


“Except as provided for by law or appropriate proclamation, employers in the private sector may, in the exercise of management prerogative and in coordination with the safety and health committee, safety officer, or any other responsible company officer, suspend work to ensure the safety and health of their employees during weather disturbances and similar occurrences,” pahayag ni DOLE chief.


Nakasaad din sa advisory na kung ang kumpanya ay kailangang magpatuloy ng kanilang operasyon sa panahon ng weather disturbances, “employee is entitled to full regular pay provided that he/she has rendered work for not less than six hours.”


“If less than six hours of work, the employee shall only be entitled to the proportionate amount of the regular pay without prejudice to existing company policy or practice more beneficial to the employee,” batay sa advisory.


Gayunman, hindi entitled ang empleyado sa regular pay kung siya ay hindi nag-report sa trabaho sa panahon ng weather disturbances, “except when there is a favorable company policy, practice, or collective bargaining agreement granting the payment of wages on the said day or when the employee is allowed to utilize his/her accrued leave credits.”


Nanawagan din si Laguesma sa mga employers na mag-provide ng extra incentives o benepisyo sa mga empleyado na magre-report sa trabaho sa kabila ng weather disturbances o masamang panahon at katulad na pangyayari.


Sinabi naman ni Laguesma, “Employees who fail or refuse to work by reason of imminent danger resulting from inclement weather conditions shall not be subject to any administrative sanction.”
