Reinstatement ng Certificate of Registration ng architect

Walong buwan na ang nakalipas matapos na ipag-utos ng Professional Regulatory Board of Architecture ang revocation ng aking Certificate of Registration. Kailan kaya maaaring maipa-reissue ang aking Certificate of Registration? – Xena

Dear Xena,

Para sa inyong kaalaman, ang batas na sumasaklaw sa sitwasyon na inyong inilahad ay ang Section 24 ng Republic Act (R.A.) No. 9266 na mas kilala bilang “The Architecture Act of 2004,” kung saan nakasaad ang sumusunod:

       “SECTION 24. Re-issuance or Replacement of Revoked or Lost Certificates of Registration Professional Identification Card or Special and Temporary Permit. - The Board may, after the expiration of two (2) years from the date of revocation of a Certificate of Registration, Professional Identification Card or special/temporary permit, and upon application and for reasons deemed proper and sufficient, reinstate the validity of a revoked Certificate of Registration and in so doing may, in its discretion, exempt the applicant from taking another examination. A new Certificate of Registration or Professional Identification Card, temporary/special permit replace those which have been lost, destroyed, or mutilated, may be re-issued, subject to the rules promulgated by the Board and the Commission, upon payment of the required fees.”  

Ibig sabihin, matapos ang dalawang taon magmula nang i-revoke ang inyong Certification of Registration ay maaari na kayong magsumite ng application upang maipa-reinstate ang inyong sertipikasyon. Maaaring magdesisyon ang Professional Regulatory Board of Architecture na ipa-reinstate ang inyong sertipikasyon kung sa kanilang pananaw ay mayroong sapat na dahilan para rito at may diskresyon ang nasabing Board na magpasyang hindi na kayo pakuhanin ng panibagong licensure examination. Sa inyong sitwasyon, hindi pa kayo maaaring maghain ng application upang ma-reinstate ang inyong Certificate of Registration dahil hindi pa natatapos ang dalawang (2) taon magmula nang revocation nito.

Nawa ay nasagot namin ang inyong mga katanungan. Nais naming ipaalala sa inyo na ang opinyong ito ay nakabase sa inyong mga salaysay sa inyong liham at sa pagkakaintindi namin dito. Maaaring maiba ang opinyon kung mayroong karagdagang impormasyon na ibibigay. Mas mainam kung personal kayong sasangguni sa abogado.
