Dear Chief Acosta,


Ang aking anak ay naglilingkod sa kumpanya kung saan siya ay nakararanas ng pambabastos mula sa kanyang supervisor. Ito ay nagbibigay ng mga tsokolate at madala’y hinahawakan siya sa kamay. Minsan ay napaaga siya ng pasok at nagkataong sila pa lamang ng kanyang supervisor ang nasa opisina. Ito ay nagtangkang halikan siya ngunit siya ay nagpumiglas. Agad niya itong inireklamo sa kanilang punong tanggapan at ito ay nangakong iimbestigahan ang nasabing pangyayari. Subalit lagpas na ang isang buwan ay wala pang aksyon mula sa kanilang punong tanggapan. Natatakot na pumasok ang aking anak at ito ay nagkakasakit na rin dahil sa takot. Nagdesisyon siyang umalis na lamang sa trabaho at magsampa ng kasong constructive dismissal. Tama ba ito? - Nora

Ang sagot sa iyong katanungan ay sinagot ng Korte Suprema sa kasong LBC Express-Vis v. Monica C. Palco, G.R. No. 217101, February 12, 2020, sa panulat ni Kagalang-galang na Mahistrado Marvic Mario Victor F. Leonen, kung saan sinabi ng Korte Suprema na ang kawalang aksyon mula sa employer sa kasong sexual harassment, kahit ito ay hindi pinahintulutan ng employer ay lumilikha ng hindi kaaya-ayang work environment na maaaring maging basehan ng constructive dismissal. Ayon sa Korte Suprema:


This provision thus illustrates that the employer must first be informed of the acts of the erring managerial officer before it can be held liable for the latter's acts. Conversely, if the employer has been informed of the acts of its managerial staff, and does not contest or question it, it is deemed to have authorized or be complicit to the acts of its erring employee.


In this case, Batucan cannot be considered to have been acting on petitioner’s behalf when he sexually harassed respondent. Thus, respondent cannot base her illegal dismissal complaint against petitioner solely on Batucan's acts. However, even if petitioner had no participation in the sexual harassment, it had been informed of the incident. Despite this, it failed to take immediate action on respondent's complaint. Its lack of prompt action reinforced the hostile work environment created by Batucan. Xxx


Clearly, there was unreasonable delay on petitioner’s part in acting on respondent’s complaint. Despite its allegations, there is no showing that petitioner acted on respondent’s report before they issued Batucan a Notice to Explain. Thus, the formal investigation is deemed to have commenced only 41 days after the incident was reported. Petitioner likewise offered no explanation as to why it took another month before it held an administrative hearing for the case..” (Emphasis Ours)


Tulad sa kaso ng iyong anak, ang lagpas isang buwan na kawalan ng aksyon mula sa kanyang employer ay nakatulong maglikha ng takot at hindi kaaya-ayang work environment para sa iyong anak. Dahil dito siya ay napilitan na lamang umalis sa kanyang trabaho para maiwasan ito. Ang nasabing kawalan ng aksyon mula sa employer ay maaaring gamiting basehan para sa constructive dismissal dahil ipinagpapalagay na pinahintulutan o kinunsinte na nito ang ginawang sexual harassment ng kanyang empleyado.
