Pag-recruit sa mga nais magtrabaho abroad nang walang lisensya, pasok sa illegal recruitment

Dear Chief Acosta,


Ang aking pamangkin ay nagamit upang mag-recruit ng kanilang mga kapitbahay para sa ipinangakong trabaho sa ibang bansa. Dahil siya ay nakapagtapos lamang ng elementarya, hindi niya alam na ito pala ay nangangailangan ng espesyal na lisensya mula sa Philippine Overseas Employment Administration o POEA. Ang ginawa lamang niya ay mag-imbita ng mga nagnanais mangibang-bansa at siya ay nakatatanggap lamang ng maliit na halaga tuwing may magbabayad ng placement fee. Siya ay kinasuhan ng Large Scale Illegal Recruitment dahil higit diumano sa tatlo ang kaniyang naimbitahan. Tama po ba ito? –Janice

Ang sagot sa iyong katanungan ay nasagot sa kasong People of the Philippines v. Oliver Imperio y Antonio, G.R. No. 232623, October 5, 2020, na isinulat ni Kagalang-galang na Mahistrado Ramon Paul L. Hernando, kung saan sinabi ng Korte Suprema ang konsepto ng “Large Scale Illegal Recruitment”. Ayon sa Korte Suprema:


“Under RA 8042, a non-licensee or non-holder of authority is liable for Illegal Recruitment when the following elements concur: (1) the offender has no valid license or authority required by law to enable him to lawfully engage in recruitment and placement of workers;

and (2) the offender undertakes any of the activities within the meaning of "recruitment and placement" under Article 13(b) of the Labor Code, or any of the prohibited practices enumerated under Article 34 of the Labor Code (now Section 6 of RA 8042). In the case of Illegal Recruitment in Large Scale, a third element is added: that the offender commits any of the acts of recruitment and placement against three or more persons, individually or as a group.

Moreover, “[t]o prove [I]llegal [R]ecruitment, it must be shown that the accused gave the complainants the distinct impression that [he or she] had the power or ability to deploy the complainants abroad in [such] a manner that they were convinced to part with their money for that end.”


Kaugnay nito, malinaw na nakasaad sa Republic Act (R.A.) No. 8042, na inamyendahan ng R.A. No. 10022, na itinuturing na illegal recruitment ang pag-refer, at pagbibigay ng pangako o paglathala ng trabaho sa ibang bansa, may kita man o wala, kung walang kaukulang lisensya ang gumagawa nito. Ayon sa batas:


“SEC. 6. Definition. - For purposes of this Act, illegal recruitment shall mean any act of canvassing, enlisting, contracting, transporting, utilizing, hiring, or procuring workers and includes referring, contract services, promising or advertising for employment abroad, whether for profit or not, when undertaken by non-licensee or non-holder of authority contemplated under Article 13(f) of Presidential Decree No. 442, as amended, otherwise known as the Labor Code of the Philippines: Provided, That any such non-licensee or non-holder who, in any manner, offers or promises for a fee employment abroad to two or more persons shall be deemed so engaged.”


Kaya naman, ang pag-iimbita ng iyong pamangkin sa mga nagnanais na aplikante para sa trabaho sa ibang bansa nang walang kaukulang lisensya mula sa POEA o anumang ahensya ng pamahalaan ay pasok sa ilalim ng depenisyon ng Illegal Recruitment. Dahil higit sa tatlo rin ang kanyang naimbitahan at nagbayad ng placement fee, siya ay pasok din sa depenisyon ng Large Scale Illegal Recruitment. (Sec. 6, R.A. No. 8042, as amended)
