Guilty ng child abuse – SC… Guro, nagpakain ng basura sa mga estudyante

Pinagtibay ng Korte Suprema with modification ang naging ruling ng Court of Appeals (CA), kung saan nabatid na isang guro ang nagawang ipasubo ang mga piraso ng basura sa bibig ng kanyang mga estudyante, na guilty ng child abuse.

Sa isang 4-pahinang notice na inilabas noong Enero 22, dineny ng Court ang inihaing petisyon ni Melany Garin habang hinatulan siya ng 4 taon, 9 buwan, at 11 araw hanggang 6 taon, 8 buwan, at isang araw ng pagkakakulong.

Ipinag-utos din ng Court kay Garin ng pagbabayad sa bata ng kabuuang P75,000, kung saan P20,000 para sa moral damages, 20,000 bilang exemplary damages, P20,000 para sa temperate damages, at P15,000 bilang multa.

Batay sa Court, “all damages awarded shall earn legal interest at the rate of 6% per annum from the finality of the resolution until fully paid.”

“On this score, petitioner’s act of forcing the victim, AAA, and his classmates to place in their mouths pieces of trash, consisting of scraps of paper, pencil shavings, dirt, and candy wrappers from the classroom’s dustpan, undoubtedly debased, degraded, and demeaned their intrinsic worth and dignity as children,” pahayag nito.

Ayon pa sa Korte, ang bata ay nag-suffer mula sa lead poisoning at nagkaroon ng Post-Traumatic Stress Disorder.

“As eloquently pronounced by the CA, no self-respecting human being would voluntarily place pieces of garbage in his or her mouth unless undoubly coerced to do so,” saad pa nito.
