Dear Chief Acosta,


Nais ng aming pamilya na magsampa ng kaso laban sa lalaking nanamantala sa aming bunsong kapatid na babae. Ang aking kapatid ay edad 13 lamang nang lokohin ng nais naming ireklamo na edad 30 na lalaki. Napag-alaman namin ito nang aming mabasa ang chat messages sa social media ng aming kapatid at ng lalaki na ito, kung saan napilit o nalinlang ng lalaki na magpadala ng mga hubad na larawan ang aming kapatid. Aming hinarap ang lalaki, pero sa aming pagkabigla, dumaing pa ng privacy violations ang lalaki. Aniya, hindi diumano maaaring magamit laban sa kanya ang mga chat messages nila ng aming kapatid kung sakaling magsasampa kami ng kaso. Totoo ba ito? - Jelly

Ang sagot sa iyong katanungan ay hindi. Sa isang kaso ng Korte Suprema na may kahawig na sitwasyon sa iyong mga nailahad, sinabi ng Kataas-Taasang Hukuman ang mga sumusunod:

“Simply put, the right to privacy is “the right to be let alone.”

While the above provision highlights the importance of the right to privacy and its consequent effect on the rules on admissibility of evidence, one must not lose sight of the fact that the Bill of Rights was intended to protect private individuals against government intrusions. Hence, its provisions are not applicable between and amongst private individuals. x x x

In this case, the photographs and conversations in the Facebook Messenger account that were obtained and used as evidence against petitioner, which he considers as fruit of the poisonous tree, were not obtained through the efforts of the police officers or any agent of the State.


Rather, these were obtained by a private individual. Indeed, the rule governing the admissibility of an evidence under Article III of the Constitution must affect only those pieces of evidence obtained by the State through its agents.

However, where private individuals are involved, for which their relationship is governed by the New Civil Code, the admissibility of an evidence cannot be determined by the provisions of the Bill of Rights.

Alinsunod sa nabanggit, malinaw na ang proteksyon na nakasaad sa ating Saligang-Batas tungkol sa Right to Privacy ay naaangkop lamang kapag ito ay iginiit laban sa Estado. Kaugnay nito, sapagkat ang chat messages na ebidensya ay inyong nakuha sa pamamagitan ng inyong kapatid at alinsunod din sa intensyon na magsampa ng kasong kriminal, bukod sa hindi maaaring maging sanggalang ang ating Saligang-Batas upang igiit ang Privacy Rights ng lalaking nais ninyong ireklamo malinaw na pinahihintulutan din ito ng ating batas alinsunod sa Data Privacy Act.


Sana ay nabigyang namin ng linaw ang iyong katanungan. Ang payong aming ibinigay ay base lamang sa impormasyon na iyong inilahad at sa pagkakaintindi namin dito. Maaaring magbago ang aming opinyon kung mababawasan o madaragdagan ang mga detalye ng iyong salaysay.
