Dear Chief Acosta,


May naipundar ang aking mga magulang na apartment (na may 3 kuwarto), katabi ng aming bahay. Bilang tulong, pansamantalang pinahintulutan ng aking mga magulang na tumira ang aming malayong kamag-anak sa bakanteng kuwarto sa nasabing apartment, at sa kondisyon na aalis sila kapag ninais at kakailanganin na naming gamitin ito. Matapos ang mahigit isang taon, inabisuhan ng aking mga magulang ang aming kamag-anak na gagamitin na ang kuwarto. Binigyan sila ng ilang buwan para makahanap ng malilipatan.  Ngunit, kahit ilang beses nakiusap, hindi pa rin umaalis ang aming kamag-anak at laging nangangatwiran. Nagpadala na rin kami ng sulat, pero hindi sila sumusunod sa aming utos.  Sa tingin namin, hindi na ito madadaan sa usapan, kung kaya binabalak na naming maghain ng reklamo sa korte. Kinakailangan bang idaan muna ito sa barangay? -- Ima

Ang Section 12, Rule 8 ng 2019 Amendments to the 1997 Rules of Civil Procedure (A.M. No. 19-10-20-SC, dated 15 October 2019) ay nagtatadhana ng mga batayan para mabalewala o ma-dismiss ang isang reklamo:


“Section 12. Affirmative defenses. – (a) A defendant shall raise his or her affirmative defenses in his or her answer, which shall be limited to the reasons set forth under Section 5(b), Rule 6, and the following grounds: xxx


5. That a condition precedent for filing the claim has not been complied with. xxx


(b) Failure to raise the affirmative defenses at the earliest opportunity shall constitute a waiver thereof. xxx” 


Kaugnay nito, alinsunod sa Rule 9 ng nasabing Rules, ang nabanggit na batayan ay dapat gamitin ng litigante sa pinakamaagang pagkakataon upang ipa-dismiss ang kaso; kung hindi, ang naturang batayan ay itinuturing na tinalikuran na:


Section 1. Defenses and objections not pleaded. – Defenses and objections not pleaded either in a motion to dismiss or in the answer are deemed waived. However, when it appears from the pleadings or the evidence on record that the court has no jurisdiction over the subject matter, that there is another action pending between the same parties for the same cause, or that the action is barred by a prior judgment or by statute of limitations, the court shall dismiss the claim.”
