Dear Chief Acosta,

Alam ko na inuuna talaga sa pila sa kahit saang establisimyento ang persons with disabilities o PWDs, pero mayroon bang partikular na batas ukol dito? Wala naman akong nakikitang mali sa pagbibigay ng priority sa kanila. Napapaisip lamang ako kung ito ba ay hindi pormal na patakaran lamang sa ating bansa, sapagkat likas sa ating mga Pilipino ang magbigay ng konsiderasyon sa mga may kapansanan o ito ba ay dahil may batas na kung hindi susundin ay may mapapataw na kaparusahan? Sana ay malinawan n’yo ako. –Elizabeth

Dear Elizabeth,

Likas sa ating mga Pilipino ang magbigay ng konsiderasyon sa mga taong mayroong kapansanan. Gayunman, nais naming bigyang-diin na ang pagkakaloob ng priority lane para sa kanila ay hindi lamang bunsod ng ugaling mapagbigay nating mga Pilipino.

Bagkus, itinatakda ito ng batas. Alinsunod sa Section 32 ng Republic Act No. 7277 o mas kilala bilang “Magna Carta for Persons with Disability”, na inamyendahan ng Republic Act No. 10754:

“SEC. 32. Persons with disability shall be entitled to:

(e) Provision of express lanes for PWD in all commercial and government establishments; in the absence thereof, priority shall be given to them.”

Nais din naming ipaalam na ang hindi pagsunod sa paglalagay ng priority lane para sa mga PWDs ay mayroong karampatang kaparusahan. Partikular na nakasaad sa Section 46 ng Republic Act No. 7277 na:

“SECTION 46. Penal Clause. - (a) Any person who violates any provision of this Act shall suffer the following penalties:

1) for the first violation, a fine of not less than Fifty thousand pesos (P 50,000.00) but not exceeding One hundred thousand pesos (P100,000.00) or imprisonment of not less than six (6) months but not more than two (2) years, or both at the discretion of the court; and

2) for any subsequent violation, a fine of not less than One hundred thousand pesos (P100,000.00) but not exceeding Two hundred thousand pesos (P200,000.00) or imprisonment for less than two (2) years but not more than six (6) years, or both at the discretion of the court.

(c) If the violator is a corporation, organization or any similar entity, the officials thereof directly involved shall be liable therefor.

(d) If the violator is an alien or a foreigner, he shall be deported immediately after service of sentence without further deportation proceedings.”

Sana ay nabigyan namin ng linaw ang iyong katanungan. Ang payong aming ibinigay ay base lamang sa mga impormasyon na iyong inilahad at maaaring magbago kung mababawasan o madaragdagan ang mga detalye ng iyong salaysay.
