Venue at hurisdiksyon ng kasong psychological violence

Dear Chief Acosta,

Nais kong magsampa ng kasong Violence Against Women laban sa aking asawa sa dinulot niyang sikolohikal na sakit sa akin at sa aming mga anak gawa ng kanyang pambababae na humantong pa sa tuluyang pagsama niya sa babaeng ito sa Mandaluyong. May nakapagsabi sa akin na kung magsasampa ako ng kaso, dapat diumano ay isampa ko sa lugar kung saan naganap ang krimen. Ako ay kasalukuyang nakatira sa Antipolo City kasama ng aking mga anak kaya mahirap sa akin magsampa ng kaso sa Mandaluyong. Dahil dito, nais kong malaman kung maaaring sa mga korte sa amin sa Antipolo ko na lang isampa ang kaso? – Haze

Dear Haze,

Ang sagot sa inyong katanungan ay opo. Ayon sa Seksiyon 7 ng Republic Act (R.A.) No. 9262, o mas kilala sa tawag na “Anti-Violence Against Women and Their Children Act of 2004,” ang venue at hurisdiksyon kung saan maaari magsampa ng kaso ay ang lugar kung saan naganap ang krimen o ang mga elemento ng krimen, viz:

“SECTION 7. Venue. - The Regional Trial Court designated as a Family Court shall have original and exclusive jurisdiction over cases of violence against women and their children under this law. In the absence of such court in the place where the offense was committed, the case shall be filed in the Regional Trial Court where the crime or any of its elements was committed at the option of the compliant.”

Sa katunayan, sa kasong AAA vs. BBB (G.R. No. 212448, January 11, 2018) na isinulat ni Honorable former Associate Justice Noel G. Tijam, sinabi ng Korte Suprema na sa kasong psychological violence, ang kaso ay maaaring isampa sa residence ng complainant: “Contrary to the interpretation of the RTC, what R.A. No. 9262 criminalizes is not the marital infidelity per se but the psychological violence causing mental or emotional suffering on the wife. Otherwise stated, it is the violence inflicted under the said circumstances that the law seeks to outlaw. Marital infidelity as cited in the law is only one of the various acts by which psychological violence may be committed. xxx. It is necessary, for Philippine courts to have jurisdiction when the abusive conduct or act of violence under Section 5(i) of R.A. No. 9262 in relation to Section 3(a), Paragraph (C) was committed outside Philippine territory, that the victim be a resident of the place where the complaint is filed in view of the anguish suffered being a material element of the offense.” (Binigyang-diin)

Sa inyong isinalaysay, nabanggit ninyong nakatira kayo sa Antipolo City, at patuloy na nakararanas ng emotional at psychological trauma, at sakit na dulot sa pagsama sa ibang babae ng inyong asawa. Dahil dito, ayon sa nabanggit na batas at desisyon ng Korte Suprema, bilang residente ng Antipolo City ay maaari kayo magsampa ng kaso sa mga korte ng lungsod na ito.
