Dear Chief Acosta,


Ang aking kapatid ay nagbebenta ng mga alahas para sa negosyante. Siya ay binibigyan ng mga alahas na ibinebenta niya sa kanyang mga kaopisina. Nitong nakaraang Disyembre, nagkaproblema ang aking kapatid at kinapos ng pera. Dahil kapaskuhan, naisip niyang isanla muna ang alahas na kanyang hawak upang siya ay magkaroon ng panggastos. Balak niya itong tubusin agad at ibenta rin sa kanyang mga kaopisina sa pagbabalik sa trabaho. Subalit biglaang nagpa-meeting ang nasabing negosyante at nagpaimbentaryo ng mga alahas na kanyang hawak. Dito natagpuan na may mga ilang kulang na alahas. Inamin ng aking kapatid na isinanla niya ang mga ito nang panandalian at kanyang tutubusin agad. Kaya lang, siya ay kinasuhan ng Estafa by Misappropriation, tama ba ito? - Rona

Ang iyong katanungan ay sinagot ng Korte Suprema sa kasong Norma C. Gamaro et al. v. People of the Philippines (G.R. No. 211917, Feb. 27, 2017), kung saan sinabi ng Korte Suprema, sa pamamagitan ni Kagalang-galang na dating Punong Mahistrado Diosdado M. Peralta (na noon ay Katuwang na Mahistrado), na ang pinarurusahan sa Article 315, par. 1(b) ng Revised Penal Code ay kung mayroon bang pera, bagay o iba pang personal na pag-aari na ipinagkatiwala sa tao at ito ay ginamit para sa ibang bagay. Ayon sa Korte Suprema:

“Also, the prosecution was able to prove the crime of estafa under paragraph 1 (b). As held by the CA, Fineza positively and categorically testified on the transaction that transpired between her and petitioners and accused Rowena Gamaro. The failure to account upon demand, for funds or property held in trust, is circumstantial evidence of misappropriation. As mentioned, petitioner Norma Gamaro failed to account for, upon demand, the jewelry which was received by her in trust. This already constitutes circumstantial evidence of misappropriation or conversion to petitioner's own personal use. The failure to return upon demand the properties which one has the duty to return is tantamount to appropriating the same for his own personal use. As in fact, in this case, Fineza, herself redeemed the pieces of jewelry using her own money.

The essence of this kind of estafa is the appropriation or conversion of money or property received to the prejudice of the entity to whom a return should be made. The words convert and misappropriate connote the act of using or disposing of another's property as if it were one's own, or of devoting it to a purpose or use different from that agreed upon. To misappropriate for one's own use includes not only conversion to one's personal advantage, but also every attempt to dispose of the property of another without right. In proving the element of conversion or misappropriation, a legal presumption of misappropriation arises when the accused fails to deliver the proceeds of the sale or to return the items to be sold and fails to give an account of their whereabouts.” (Emphasis Ours)

Tulad sa kaso ng iyong kapatid, nang nagkaroon sila ng pag-iimbentaryo at hindi niya naipakita ang mga alahas na nasa kanyang pangangalaga sapagkat ito ay kanyang isinanla, masasabi na nagkaroon ng conversion o misappropriation ng mga alahas na ito na nakatakda upang ibenta. Dahil dito, nagkaroon ng paglabag sa Art. 315, par. 1(b) ng Revised Penal Code.
