Tamang korte para magsampa ng kasong libel

Dear Chief Acosta, Siniraan ako sa social media ng dati kong kakilala kaya balak ko siyang sampahan ng kasong libel. Nais kong malaman kung saan at anong korte ang maaaring humawak sa kaso dahil ang nanira sa akin ay nakatira sa malayong lugar? — Selena

Dear Selena, Para sa inyong kaalaman, ang libel na ginawa gamit ang computer system ay saklaw ng Republic Act No. 10175 o ang “Cybercrime Prevention Act of 2012”. Ayon sa Section 21 ng nasabing batas:

“Section 21. Jurisdiction. — The Regional Trial Court shall have jurisdiction over any violation of the provisions of this Act including any violation committed by a Filipino national regardless of the place of commission. Jurisdiction shall lie if any of the elements was committed within the Philippines or committed with the use of any computer system wholly or partly situated in the country, or when by such commission any damage is caused to a natural or juridical person who, at the time the offense was committed, was in the Philippines.”

Sang-ayon sa nasabing batas, ang Regional Trial Court (RTC) ang may hurisdiksiyon sa kasong libel na ginawa gamit ang computer system. Kaugnay pa rito, ang nasabing batas ay binigyang-linaw ng Section 22, Rule 4 ng Implementing Rules and Regulations ng nasabing batas kung saan nakasaad na:

“Section 22. Venue. – Criminal action for violation of the Act may be filed with the RTC of the Province or city where the cybercrime or any of its elements is committed, or where any part of the computer system used is situated, or where any of the damage caused to a natural or juridical person took place: Provided, That the court where the criminal action is first filed shall acquire jurisdiction to the exclusion of other courts.”

Samakatwid at alinsunod sa nabanggit na mga batas, ang nasabing krimen ay maaaring ihain sa mga sumusunod na lugar:

1. Regional Trial Court kung saan nangyari ang mga elemento ng libel;

2. Regional Trial Court kung saan matatagpuan ang computer system na ginamit upang makamit ang naturang krimen at

3. Regional Trial Court kung saan nabasa ang nasabing paninira.

Nawa ay nasagot namin ang inyong mga katanungan. Nais naming ipaalala sa inyo na ang opinyong ito ay nakabase sa inyong mga naisalaysay sa inyong liham at sa pagkakaintindi namin dito. Maaaring maiba ang opinyon kung mayroong karagdagang impormasyong ibibigay. Mas mainam kung personal kayong sasangguni sa isang abogado.
