Provincial Agrarian Reform Adjudicator, may “K” magpatawag ng testigo

Dear Chief Acosta, Nais kong malaman kung maaari ba akong ipatawag ng Provincial Agrarian Reform Adjudicator (PARAD) bilang testigo sa kaso sapagkat ako ay nakatanggap ng summons para rito. — Elsa

Dear Elsa, Para sa inyong kaalaman, ang panuntunang naaangkop sa inyong sitwasyon ay ang Section 6, Rule II ng 2009 Department of Agrarian Reform Adjudication Board (DARAB) Rules of Procedure kung saan nakasaad na:

“RULE II

Jurisdiction of the Board and Adjudicators

SECTION 6. Powers. — The Members of the Board and the Adjudicators are empowered to summon witnesses, administer oaths, take testimony, require submission of reports, compel production of books and documents and answers to interrogatories, and to issue subpoena duces tecum, writs of possession, writs of execution, and other writs to enforce its orders and decisions through their Sheriffs or duly deputized officers.

For this purpose, whenever necessary, they shall direct the Philippine National Police, the Armed Forces of the Philippines or any of their component units, or other law enforcement agencies to assist in the enforcement and execution of their decisions, orders, writs, and other processes.” (Binigyang-diin)

Malinaw sa nabanggit na panuntunan na mayroong kapangyarihan ang Provincial Agrarian Reform Adjudicator (PARAD), gayundin ang Department of Agrarian Reform Adjudication Board (DARAB) na magpatawag ng testigo, mangasiwa ng panunumpa, mag-isyu ng subpoena at iba pa pagdating sa mga reklamong isinampa rito. Bukod pa rito, nakasaad din sa nabanggit na panuntunan na maaaring bigyang direktiba ng PARAD o DARAB ang Pambansang Pulisya at Sandatahang Lakas ng Pilipinas at ang iba pang ahensiyang nagpapatupad ng batas upang magbigay-tulong sa pagpapatupad ng mga desisyon, direktiba at writs na naisyu ng PARAD at DARAB.

Nawa ay nasagot namin ang inyong katanungan. Nais naming ipaalala sa inyo na ang opinyong ito ay nakabase sa inyong mga naisalaysay sa inyong liham at sa pagkakaintindi namin dito. Maaaring maiba ang opinyon kung mayroong karagdagang impormasyong ibibigay. Mas mainam kung personal kayong sasangguni sa abogado.
