Homeowners’ association, may 'k' ipagawa ang club-house ng subdivision pero may limitasyon

Dear Chief Acosta,

Mayroon bang kapangyarihan ang aming Homeowners’ Association upang basta na lamang ipagawa at palagyan ng swimming pool ang club house ng aming subdivision? Kung sakali, may limitasyon ba ito? — Crystal

Dear Crystal,

Para sa inyong kaalaman, ang batas na nakasasaklaw sa inyong katanungan ay ang Sec. 49, Rule 9, Implementing Rules and Regulations ng Republic Act No. 9904 o mas kilala sa tawag na “The Magna Carta for Homeowners and Homeowners Associations” kung saan nakasaad na:

“Section 49. Rights and Powers of the Association. – An association shall have the following rights and powers:

x xx

c. Regulate the use, maintenance, repair, replacement and modification of common areas and cause additional improvements to be made part of the common areas: Provided, that the aforementioned do not contradict the provisions of the approved subdivision plan;” (Binig­yang-diin at sinalungguhitan)

Samakatwid, malinaw sa batas na mayroon namang kapangyarihan ang homeowners’ association na mag­pa­gawa at pagandahin ang mga common areas ng inyong subdivision tu­lad ng club house. Subalit, limitado ang kapangyarihang ito sapagkat hindi nito maaaring salungatin ang approved subdivision plan ng inyong lugar.

Nawa ay nasagot namin ang inyong katanungan. Nais naming ipaalala sa inyo na ang opinyong ito ay nakabase sa inyong mga naisalaysay sa inyong liham at sa pagkakaintindi namin dito. Maaaring maiba ang opinyon kung mayroong karagdagang impormasyong ibibigay. Mas mainam kung personal kayong sasangguni sa abogado.
