Dear Angelica, Para sa inyong kaalaman, ang pagnenegosyo ng pagkain nang walang kaukulang permit ay ipinagbabawal ng Section 38 (f) ng Republic Act No 10611 o mas kilala sa tawag na “Food Safety Act of 2013” kung saan nakasaad: “It shall be unlawful for any person to operate a food business without the appropriate authorization.” Ang sinumang tao na lalabag sa nasabing probisyon ay papatawan ng parusa alinsunod sa Section 38 ng nasabing batas kung saan nakasaad:

“Sec. 38. Penalty. – Any person who shall violate any provision of this Act shall suffer the penalties provided hereunder:

(a) For the first conviction, a fine of not less than fifty thousand pesos (P50,000) but not more than one hundred thousand pesos (P100,000) and suspension of appropriate authorization for one (1) month shall be imposed;

(b) For the second conviction, a fine of not less than one hundred thousand pesos (P100,000) but not more than two hundred thousand pesos (P200,000) and suspension of appropriate authorization for three (3) months shall be imposed;

(c) For the third conviction, a fine of not less than two hundred thousand pesos (P200,000) but not more than three hundred thousand pesos (P300,000) and suspension of appropriate authorization for six (6) months shall be imposed; xxx

If the offender does not have the appropriate authorization, the imposable fines shall be doubled xxx” (Binigyang-diin).

Samakatwid ang sinumang lalabag sa nabanggit na batas ay papatawan ng multa na nagkakahalagang P50,000 hanggang P300,000 at ito ay maaaring doblehin dahil sa pagnenegosyo ng pagkain na walang kaukulang permit.
