Ninakawan na credit card, nababahala dahil sinisingil na ng issuing bank

Dear Chief Acosta,

Magandang araw! Hindi ko mahanap ang credit card ko kaya agad ko itong ipinagbigay-alam sa issuing bank nito. Sa kasamaang-palad, nagamit na ang credit card ko nang kumuha nito bago ko pa man mai-report. Nababahala ako dahil sinisingil na ako ng bangko tungkol dito. Nais kong malaman kung tama ba ito? — PJ

Dear PJ,

Para sa inyong kaalaman, ang inyong credit card ay maikokonsidera na access device sang-ayon sa Section 3 (a) ng Republic Act No. 8484 o mas kilala bilang “Access Devices Regulation Act of 1998” na:

“Section 3. Definition of terms. – For purposes of this Act, the terms:

a. Access Device – means any card, plate, code, account number, electronic serial number, personal identification number, or other telecommunications service, equipment, or instrumental identifier, or other means of account access that can be used to obtain money, good, services, or any other thing of value or to initiate a transfer of funds (other than a transfer originated solely by paper instrument);”

Ayon sa Section 15 ng parehong batas:

Section 15. Loss of access devices. – In case of loss of an access device, the holder thereof must notify the issuer of the access device of the details and circumstances of such loss upon knowledge of the loss. Full compliance with such procedure would absolve the access device holder of any financial liability from fraudulent use of the access device from the time the loss or theft is reported to the issuer.” (Binigyang-diin)

Ibig sabihin, mawawala lamang ang inyong obligasyon na magbayad sa oras na maipagbigay-alam ninyo ito sa inyong issuing bank. Sa inyong sitwasyon, kung ginamit ng mag­nanakaw ang inyong credit card bago pa ninyo ito mai-report, kinaka­ilangan ninyong bayaran ang halaga na naidulot o nagamit kaugnay nito.

Nawa ay nasagot namin ang inyong katanungan. Nais naming ipaalala sa inyo na ang opinyong ito ay nakabase sa inyong mga naisalay­say sa inyong liham at sa pagka­kaintindi namin dito. Maaaring maiba ang opinyon kung mayroong karagdagang impormasyong ibibigay. Mas mainam kung personal kayong sasangguni sa abogado.
