Kuwalipikadong magsilbi sa eleksiyon kapag kinulang sa mga boluntaryong guro

Magandang araw! Nais kong malaman na bukod sa mga public school teacher, sinu-sino pa ang maaaring italaga ng Comelec upang magsilbi sa eleksiyon? — Roanne

Dear Roanne,

Para sa inyong kaalaman, ang inyong katanungan ay tinatalakay sa Section 3 ng Republic Act No. 10756 o mas kilala sa tawag na “Election Service Reform Act” kung saan nakasaad na;

“Section 3. Rendering of Election Service. – x x x

Should there be lack of public school teachers willing, available or qualified to serve, the Commission may instead appoint the following persons in this order of preference:

a) Private school teachers

b) National government employees;

1. DepEd nonteaching personnel;

2. Other national government officials and employees holding regular or permanent positions, excluding uniformed personnel of the Department of National Defense and all its attached agencies;

c.) Members of the Commission-accredited citizen arms or other civil society organizations and nongovernmental organizations duly accredited by the Commission; and

d.) Any registered voter of the city or municipality of known integrity and competence who is not connected with any candidate or political party.

In cases where the peace and order situation so requires as determined by the Commission and where there are no qualified voters willing to serve, uniformed personnel of the Philippine National Police shall be deputized to render election service as a last resort.” [Binigyang-diin.]

Ayon sa nabanggit na probisyon ng batas, kung may kakulangan sa mga public school teacher na pumayag, magagamit at kuwalipikadong magsil­bi kapag hiniling, maaaring italaga ng Commission on Elections (Come­lec) ang mga sumusunod upang magsilbi sa eleksiyon, ayon sa pagkakasunud-sunod:

a) Mga guro mula sa pribadong paaralan;

b) Mga empleyado ng gobyerno maliban na lamang sa miyembro ng military;

c) Mga miyembro ng commission accredited citizens’ arms;

d) Mga rehistradong botante na hindi konektado sa kahit na sinong kandidato o partido at

e) Kung kinakailangan upang mapanatili ang kaayusan at wala nang iba pang kuwalipikadong rehistra­dong botante ay maaaring italaga ang mga miyembro ng Philippine National Police.

Nawa ay nasagot namin ang inyong katanungan. Nais naming ipaalala sa inyo na ang opinyong ito ay nakabase sa inyong mga naisalay­say sa inyong liham at sa pagkakain­tin­di namin dito. Maaaring maiba ang opinyon kung mayroong karagda­gang impormasyong ibibigay. Mas mainam kung personal kayong sasangguni sa abogado.
