Ako ay tsuper ng pampasaherong jeep. May alam akong gaso­linahan na nagbe­ben­ta ng murang krudo. Napag-alaman kong mayroon silang iniha­halong organic na kemikal sa kanilang diesel upang maiwa­san ang pagbuga ng maitim na usok ng aking jeep. Ang batas na suma­saklaw sa inyong sit­was­yon ay ang Section 12 ng Republic Act (R.A.) No. 8479 na mas kilala bilang “Downstream Oil Industry Deregulation Act of 1998” kung saan naka­lahad ang mga sumu­sunod:

“Section 12. Other Prohibited Acts. – To ensure compliance with the provisions of this Act, the refusal to comply with any of the following shall likewise be prohibited:

(a) submission of any reportorial requirements;

(b) use of clean and safe (environment and worker-benign) technologies;

(c) any order or instruction of the DOE Secretary issued in the exercise of his enforcement powers under Section 15 of this Act; and

(d) registration of any fuel additive with the DOE prior to its use as an additive.

Any person, including but not limited to the chief operating officer or chief executive officer of the partnership, corporation or any entity involved, who is found guilty of any of the said prohibited acts shall suffer the penalty of imprisonment for two (2) years and a fine ranging from two hundred fifty thousand pesos (P 250,000) to five hundred thousand pesos (P500,000).” (Binig­yan-diin)

Malinaw sa mga na­banggit na mahigpit na ipinagbabawal ang pag­daragdag ng fuel additive hangga’t hindi ito naparerehistro sa Department of Energy (DOE). Sa inyong sit­was­yon, ang gasolina­han na naghalo ng kemi­kal sa kanilang ibine­ben­tang krudo ay maa­aring managot sa batas kung mapatutunayang ang kemikal (fuel additive) na ito ay hindi re­his­trado sa DOE. Kaug­nay nito, maaaring makulong at pagmul­tahin ng huku­man ang sinumang mapatu­na­yang lumabag sa nasabing batas.
