Nararapat na matanggap matapos matanggal sa trabaho ng walang dahilan

Dear Chief Acosta,

Natanggal ako sa trabaho bilang family driver kamakailan sa hindi ko malamang dahilan. Ang sabi sa akin ay isang buwang suweldo lang daw ang ibibigay sa akin kahit na mahigit tatlong taon akong nanilbihan sa kanila. Nais kong malaman kung ano ang nararapat kong makuha na sang-ayon sa batas? — Monta

Dear Monta,

Para sa inyong kaalaman ang family driver ay nasasaklawan ng Article 141 ng Labor Code of the Philippines. Ayon sa nabanggit:

“Article 141. Coverage. This Chapter shall apply to all persons rendering services in households for compensation.

“Domestic or household service” shall mean service in the employer’s home which is usually necessary or desirable for the maintenance and enjoyment thereof and includes ministering to the personal comfort and convenience of the members of the employer’s household, including services of family drivers.”

Kaugnay nito, nakasaad sa Article 149 ng parehong panuntunan na kapag natanggal sa trabaho ang taong nasa domestic o household service, siya ay nararapat na maka­tanggap ng kanyang huling suweldo.

“Article 149. Indemnity for unjust termination of services. If the period of household service is fixed, neither the employer nor the househelper may terminate the contract before the expiration of the term, except for a just cause. If the househelper is unjustly dismissed, he or she shall be paid the compensation already earned plus that for fifteen (15) days by way of indemnity.

If the househelper leaves without justifiable reason, he or she shall forfeit any unpaid salary due him or her not exceeding fifteen (15) days.”(Binigyang-diin)

Malinaw sa mga nabanggit na probisyon ng Labor Code na kung sakaling tinanggal sa kanyang trabaho ang family driver nang walang sapat na dahilan, siya ay nararapat na maka­tanggap ng kanyang huling suweldo at ng labinlimang (15) araw pa niyang suweldo na tinatawag ding indemnity.

Nawa ay nasagot namin ang inyong mga katanungan. Nais naming ipaalala sa inyo na ang opinyong ito ay nakabase sa inyong mga naisalaysay sa inyong liham at sa pagkakaintindi namin dito. Maaaring maiba ang opinyon kung mayroong karagdagang impormasyong ibibigay. Mas mainam kung personal kayong sasangguni sa isang abogado.
