Multa at pagkakakulong sa may-ari ng hotel na hindi magbibigay ng discount sa mga senior citizens

Dear Chief Acosta, Nais kong upahan ang conference hall ng hotel upang doon maganap ang anniversary ng aming samahan na senior citizens. Pero wala raw silang ibinibigay na diskuwento rito kahit kami ay senior citizens. Tama ba ang naturang hotel? - Adelaida

Dear Adelaida, Ang batas na sumasaklaw sa inyong sitwasyon ay ang Section 4 (a) (7) ng Republic Act No. 9994 o mas kilala bilang “Expanded Senior Citizens Act of 2010” kung saan nakalahad ang mga sumusunod:

“Section 4 of Republic Act No. 7432, as amended by Republic Act No. 9257, otherwise known as the “Expanded Senior Citizens Act of 2003”, is hereby further amended to read as follows:

“SEC. 4. Privileges for the Senior Citizens.

The senior citizens shall be entitled to the following:

(a) The grant of twenty percent (20%) discount and exemption from the value added tax (VAT), if applicable, on the sale of the following goods and services from all establishments, for the exclusive use and enjoyment or availment of the senior citizen

(7) on the utilization of services in hotels and similar lodging establishments, restaurants and recreation centers;”

Dagdag pa rito, nakalagay sa nabanggit na batas ang mga parusa sa sinumang tao na lumabag sa batas na ito. Ito ay ang mga sumusunod:

“Section 7. Section 10 of the same Act, as amended, is hereby further amended to read as follows:

“SEC. 10. Penalties. — Any person who refuses to honor the senior citizen card issued by the government or violates any provisions of this Act shall suffer the following penalties:

“(a) For the first violation, imprisonment of not less than two (2) years but not more than six (6) years and a fine of not less than fifty thousand pesos (Php 50,000) but not exceeding one hundred thousand pesos (Php 100,000);”

Malinaw sa mga nabanggit na binibigyan ng 20% ang senior citizen sa mga serbisyo ng mga hotel. Ang sinuman na lumabag dito ay maaaring maparusahan ng multa at pagkabilanggo sa diskresyon ng hukuman. Samakatwid, maaaring maparusahan ang may-ari ng hotel kung igigiit niya ang hindi pagbibigay ng diskuwento sa inyo.
