Kaso sa Dengvaxia, tuloy — Korte.. Garin, sopla!

Ipinag-utos na ng Quezon City Regional Trial Court ang pag-usad ng kaso laban kay dating Health Secretary at ngayo’y Iloilo Rep. Janette Garin, na may kaugnayan sa Dengvaxia.

Sa 3 pahinang kautusan ni Quezon City RTC Judge Maria Gilda Loja-Pangilinan, ibinasura nito ang mosyon ni Garin na maibasura ang kaso laban sa kanya dahil sa kawalan ng merito.

Ang kaso ay isinampa ng tatay ni Zandro Colite, 11-anyos na batang namatay dahil umano sa anti-dengue vaccine na Dengvaxia.

Ang bata ay namatay noong Disyembre 27, 2017 dahil sa multiple organ bleeding matapos umanong makatanggap ng Dengvaxia vaccine.

Humihingi ang pamilya ng biktima ng actual at compensatory damages na nagkakahalaga ng P2.3 million; civil indemnity, P50,000; moral damages, P400,000 at exemplary damages, P400,000.

Ayon naman sa korte, may nakita itong basehan para ituloy na ang trial sa kaso.“Upon perusal of the complaint, the court finds the allegations in the complaint sufficient to constitute a cause of action, and defendant’s averments as merely directed to the veracity and correctness of the allegations found therein,” bahagi ng nakasaad sa desisyon ng korte.

Sa mosyon ni Garin, kinuwestiyon nito ang venue ng kaso dahil hindi umano siya residente ng Quezon City kaya dapat lang itong maibasura.

“The court finds that venue properly laid by the plaintiff when he chose to file the instant complaint in this court by reason of the residence of one of the impleaded defendants which he considers as a principal defendant,” nakasaad sa desisyon ng korte.

Si Garin ay nahaharap sa mga kasong reckless imprudence resulting in homicide at paglabag sa Anti-Torture Act at Consumer Act.
