Vice-Mayor, may 'K' mag-kasal 'pag wala ang Mayor

Dear Chief Acosta, Magpapakasal na kami ng BF ko at dahil maliit lang ang budget namin ay nagdesisyon kaming sa municipal mayor magpakasal. Pero nalaman naming pupunta sa ibang bansa si mayor sa kaparehong petsa ng kasal namin. Gayunman, ang sabi ng nakausap namin sa city hall, vice-mayor daw ang maaaring gumawa nito. Maaari ba kaming ikasal ng vice-mayor kung wala ang aming mayor? - Rits

Dear Rits, Ayon sa Chapter 3, Article 1, Section 444 [xviii] ng Republic Act No. 7619 o mas kinikilala bilang “Local Government Code of the Philippines,” ang mayor ng munisipalidad ay may kapangyarihang mag-solemnize ng kasal, hindi liban ang alinmang probisyon ng batas:

“Section 444. The Chief Executive: Powers, Duties, Functions and Compensation. –

(a) The municipal mayor, as the chief executive of the municipal government, shall exercise such powers and performs such duties and functions as provided by this Code and other laws.

(b) For efficient, effective and economical governance the purpose of which is the general welfare of the municipality and its inhabitants pursuant to Section 16 of this Code, the municipal mayor shall:

“(xviii) Solemnize marriages, any provision of law to the contrary notwithstanding; xxx.”

Gayunman, kung ang mayor ay temporarily incapacitated para gampanan ang kanyang mga responsibilidad nang dahil sa pisikal o legal na kadahilanan, tulad ng pag-leave of absence, pangingibang-bansa at pagkasuspinde sa trabaho, ang vice-mayor o ang miyembro ng Sangguniang Bayan na siyang may pinakamataas na ranggo ang maaaring gumanap sa mga responsibilidad ng mayor, maliban na lang sa pag-appoint, suspend o pagtanggal sa mga empleyado na maaari lamang gawin ng nasabing mga indibidwal kung ang temporary incapacity ay lalagpas nang tatlumpung (30) araw. Ito ay sang-ayon sa Section 46 at 445[4] ng nasabing batas:

“Section 46. Temporary Vacancy in the Office of the Local Chief Executive. – (a) When the governor, city or municipal mayor, or punong barangay is temporarily incapacitated to perform his duties for physical or legal reasons such as, but not limited to, leave of absence, travel abroad, and suspension from office, the vice-governor, city or municipal vice-mayor, or the highest ranking sangguniang barangay member shall automatically exercise the powers and perform the duties and functions of the local chief executive concerned, except the power to appoint, suspend, or dismiss employees which can only be exercised if the period of temporary incapacity exceeds thirty (30) working days.

“Section 445. Powers, Duties and Compensation. –

(a) The vice-mayor shall:

(4) Exercise the powers and perform the duties and functions of the municipal mayor in cases of temporary vacancy as provided for in Section 46, Book I of this Code; xxx”

Sa inyong sitwasyon, ang pagpunta ng inyong mayor sa ibang bansa sa araw ng inyong balak na pagpapakasal ay hindi balakid sa inyong pag-iisang-dibdib sapagkat maaaring gampanan ang nasabing responsibilidad ng inyong vice-mayor.

Nawa ay nasagot namin ang inyong mga katanungan. Nais naming ipaalala sa inyo na ang opinyong ito ay nakabase sa inyong mga naisalaysay sa inyong liham at sa pagkakaintindi namin dito. Maaaring maiba ang opinyon kung mayroong karagdagang impormasyong ibibigay. Mas mainam kung personal kayong sasangguni sa isang abogado.
