Dear Chief Acosta, Noong bisperas ng Pasko ay bumili ako ng inumin sa isang tindahan na nasa loob ng terminal ng bus. Gayunman, kung kailan iinumin ko na sana ang aking nabiling inumin ay saka ko lang napansin na expired na pala ito. Mura lamang ang halaga ng inuming ito pero gusto kong malaman kung may pananagutan ba ang naturang tindahan sa patuloy na pagbebenta ng expired na produkto? - Jane

Dear Jane, Nasasaad sa Republic Act (R.A.) No. 7394 o “Consumer Act of the Philippines” na ang produkto tulad ng inumin ay kinokonsiderang “adulterated” kapag ito ay expired na.

Bilang adulterated na produkto, ang pagbebenta ng expired na inumin o pagkain ay ipinagbabawal at pinarurusahan ang sinumang magbebenta o nagbenta nito. Narito ang probisyon ng R.A. No. 7394 tungkol dito:

“Article 40. Prohibited Acts. – The following acts and the causing thereof are hereby prohibited:

a) the manufacture, importation, exportation, sale, offering for sale, distribution or transfer of any food, drug, device or cosmetic that is adulterated or mislabeled;

“Article 41. Penalties. –

a. Any person who violates any of the provisions of Article 40 hereof shall, upon conviction, be subject to imprisonment of not less than one (1) year but not more than five (5) years, or a fine of not less than five thousand pesos (P5, 000) but not more than ten thousand pesos (P10,000) or both such imprisonment and fine, in the discretion of the Court.

Should the offense be committed by a juridical person, the Chairman of the Board of Directors, the President, General Manager, or the partners and/or the persons directly responsible therefore shall be penalized.”
