Epekto ng hindi pagtupad sa service contract ng iskolar

Ano ang epekto kung hindi tutuparin ng iskolar ang kon­trata sa serbisyo kaugnay sa Junior Level Science Scholarship mula sa Department of Science and Technology (DOST)? — Christine

Dear Christine,

Para sa inyong kaalaman, ang epekto ng hindi pagtupad sa mga tuntunin ng kontrata sa serbisyo ng iskolar ay binigyang-linaw sa Section 9 ng Republic Act (R.A.) No. 10612 o mas kilala bilang “Fast-Tracked S&T Scholarship Act of 2013.” Nakasaad dito na:

“SEC 9. Terms and Conditions. – Applicants for the scholarship must execute a service contract which they:

a. Agree to teach as their return of service (ROS);

b. Agree to any of the approved ROS conditions; and

c. Agree to repay the amounts disbursed plus interest pursuant to the terms of their service contract.

Failure to comply with the terms of the service contract will result in the full repayment (plus penalties, if applicable) of all award monies received within a specified time limit.” (Binigyang diin)

Maliwanag sa nasa­bing batas na babayaran ng iskolar nang buo ang lahat ng kanyang mga natanggap na pera mula sa scholarship sa loob ng tinukoy sa oras kasama ang penalties nito kung naaangkop.

Nawa ay nasagot namin ang inyong katanungan. Nais na­ming ipaalala sa inyo na ang opinyong ito ay nakabase sa inyong mga naisalaysay sa inyong liham at sa pagka­kaintindi namin dito. Maaaring maiba ang opinyon kung mayro­ong karagdagang impor­masyong ibibigay. Mas mainam kung personal kayong sasangguni sa abogado.
