Kung ang technical description ng titulo ang basehan ng tunay na sukat ng lupain

Dear Chief Acosta,

Nagbabalak bumili ng maliit na lupain sa probinsiya ang pamilya ko. Nagplano kaming ipa-survey ito upang malaman ang tunay na sukat. Nais naming malaman kung anong sukat ang masusunod, kung ang boundary ng lupa ayon sa technical description na nakasaad sa titulo ay iba sa nakalagay na area nito? — Dana

Dear Dana,

Para sa inyong kaalaman, ang general rule ay ang nakasaad na boundary ng lupa ang dapat masunod upang malaman ang tunay na sukat nito kung ito ay hindi tugma sa nakalagay nitong area. Sa desisyon ng Korte Suprema sa kasong Luis Balantakbo, etal. vs. Court of Appeals (G.R. No. 108515 October 16, 1995, citing Dichoso v. Dichoso vs. Court of Appeals, 192 SCRA 169 [1990]) na isinulat ni dating Punong Mahistrado Andres Narvasa, ipinaliwanag na:

“The issue here may be stated simply, thus: In case of conflict between the area described and the actual boundaries of the land, which should prevail?

And it is by no means a novel question. On the contrary, the rule is quite well-settled that what really defines a piece of land is not the area, calculated with more or less certainty mentioned in the description, but the boundaries therein laid down, as enclosing the land and indicating its limits.

In Dichoso, supra, this Court held:

. . . In a contract of sale of land in mass, it is well established that the specific boundaries stated in the contract must control over any statement with respect to the area contained within its boundaries. It is not of vital consequence that a deed or contract of sale of land should disclose the area with mathematical accuracy. It is sufficient that its extent is objectively indicated with sufficient precision to enable one to identify it. An error as to the superficial area is immaterial.”

Malinaw sa nabanggit na desisyon na nakasaad na boundary ng isang lupa, alinsunod sa technical description nito, ang mananaig upang malaman ang tunay na sukat nito.

Nawa ay nasagot namin ang inyong katanungan. Nais naming ipaalala sa inyo na ang opinyong ito ay nakabase sa inyong mga naisalay­say sa inyong liham at sa pagkakain­tindi namin dito. Maaaring maiba ang opinyon kung mayroong karagdagang impormasyong ibibigay. Mas mainam kung personal kayong sasangguni sa abogado.
