P5M multa at 2 Yrs. kulong sa nagpalsipika ng pagpaparehistro ng foundling

Dear Chief Acosta,

Mayroon bang maikakaso sa isang tao na posibleng nagdoktor o nagpalsipika ng dokumento kaugnay sa pagpaparehistro ng isang bata bilang “foundling”? Mayroon kasing nakapagsabi sa kakilala ko na naparehistro diumano ang nawala niyang anak bilang isang “foundling”. Ang alam ko ay inaasikaso na ng kakilala ko ang paghahain ng reklamong kidnapping o serious illegal detention sa kumuha sa kanyang anak, ngunit ang nais niyang malaman ngayon ay kung mayroon din ba siyang maikakaso sa taong posibleng nagdoktor sa anumang dokumento na mayroong kaugnayan sa pagpaparehistro sa kanyang anak bilang “foundling”. Sana ay makapagbigay kayo ng payo sa akin. - Mario

Dear Mario,

Mayroon tayong partikular na batas na sumasaklaw sa pagkilala at pagbibigay ng proteksyon sa mga tao na kinokonsidera bilang mga “foundlings” o mga inabandonang bata na walang pagkakakilanlan ang mga magulang o impormasyon ng kapanganakan.

Ito ay ang Republic Act (R.A) No. 11767, o mas kilala bilang “Foundling Recognition and Protection Act.” Layunin ng R.A. No. 11767 na masiguro na maibibigay ang angkop na proteksyon sa pamamagitan ng masikap at maagap na pagsisiyasat at pangangalap ng impormasyon ukol sa mga bata na inabandona o pinabayaan ng kanilang mga magulang upang mabawasan o maiwasan ang pagkawala ng kanilang estado o “statelessness”. (Section 2, id)

Alinsunod sa Section 13 ng R.A. No. 11767, maaaring magsampa ng reklamo sa sinumang sangkot sa pagpalsipika ng dokumento na mayroong kaugnayan sa pagpaparehistro ng isang foundling. Mayroong higit na mabigat na kaparusahang pagkakakulong at multa sa sinumang sangkot sa palsipikasyon na mayroong kaugnayan sa kidnapping o trafficking in persons. Batay sa Section 17 ng naturang batas:

“Section 17. Penalties. - The following penalties shall be imposed:

a. The penalty of imprisonment of not less than six (6) months but not more than six (6) years shall be imposed on any person who falsifies or is involved in the falsification of the registration of the supposed foundling, including the documents required therefor: Provided, That a public officer found to have been involved in such act of falsification shall be punished by the penalty next higher in degree;

1. Without prejudice to criminal liability under other laws, a fine ranging from One million pesos (P1,000,000.00) to Five million pesos (P5,000,000.00) or imprisonment of not less than three (3) months but not more than two (2) years, or both, shall be imposed on any person who falsifies or is involved in the falsification of the registration of the supposed foundling, including the documents required therefor, to facilitate the crime of kidnapping or trafficking in persons: Provided, That a public officer found to have been involved in such act of falsification shall be punished by the penalty next higher in degree and shall perpetually disqualified from office.

The penalties under this section are without prejudice to other liabilities arising from existing civil, administrative and criminal laws for the same act or violation.”

Para sa karagdagang legal na payo, maaaring sumangguni ang iyong kakilala sa PAO District Office ng lugar kung saan siya nakatira. Mangyaring dalhin ang lahat ng mga dokumento na mayroong kaugnayan sa kanyang nabanggit na suliranin upang mapag-aralan ang angkop na legal na hakbang na maaari niyang gawin.

Discount ng senior sa grocery

Bakit kaya sa tuwing namimili ako sa grocery ay P65.00 lamang ang naibibigay sa aking diskwento bilang senior citizen? Kahit pa marami sa mga pinamili ko ay pasok naman sa kategorya ng mga dapat na madiskwentuhan tulad ng tinapay, bigas, sabon at iba pang mga kinokonsumo ko sa bahay. Para pong pinipili lamang ng kahera kung alin sa mga napamili ko ang ipapasok niya para madiskwentuhan at laging papatak na hanggang P65.00 lamang ang mababawas sa kabuuang resibo ko. Sana ay malinawan ninyo ako. - Benigno

Dear Benigno,

Ang diskwento na ibinibigay sa mga senior citizen ay alinsunod sa mga ipinapatupad na batas at panuntunan. Para sa mga basic commodities o mga payak at pangunahing bilihin tulad ng tinapay, bigas, sabon at iba, nakasaad sa Section 4 ng Republic Act (R.A.) No. 9994, o mas kilala bilang “Expanded Senior Citizens Act of 2010”, na:

“SEC. 4. Privileges for the Senior Citizens. – The senior citizens shall be entitled to the following: (j) to the extent possible, the government may grant special discounts in special programs for senior citizens on purchase of basic commodities, subject to the guidelines to be issued for the purpose by the Department of Trade and Industry (DTI) and the Department of Agriculture (DA).”

Malinaw na nakasaad sa Section 3 ng DA-DTI Joint Administrative Order No. 10-02, Series of 2010 na 5% ang diskwento, mula sa regular na presyo, ang maaaring ibigay sa mga senior citizen para sa lingguhang halaga ng pamimili ng basic necessities and prime commodities:

“Section 3. Discount – Every senior citizen shall enjoy a special discount of five percent (5%) of the regular retail price, without exemption from value-added tax (VAT), of basic necessities and prime commodities listed under Section 2 (a) and (b) of this Order. The total amount of said purchase shall not exceed the amount of One Thousand Three Hundred Pesos (P1,300.00) per calendar week without carry over of the unused amount. Provided, that said amount shall be spent on items listed under Section 2 (a) and (b) of this Order commensurate to his/her personal and exclusive consumption and/or enjoyment within the calendar week.

Provided, further that said amount shall be spent on at least four (4) kinds of items listed under Section 2 (a) of this Order.”

Ang kawangis na probisyon ukol sa nasabing diskwento ay nakasaad din sa Section 5 ng DTI-DSWD-NCSC-NCDA-DOH-DILG-BIR Joint Memorandum (JMC) No. 01, Series of 2022:

“Section 5. Basic Necessities and Prime Commodities (BNPCs):

The total amount of offline and online purchase of Senior Citizens and Persons with Disability per calendar week shall not exceed the amount of One Thousand Three Hundred Pesos (P1,300.00) without carry over of the unused amount, unless otherwise increased, as may be determined by the DTI and other relevant agencies. Provided that the purchase of medicine shall no longer be limited by the P1,300.00 ceiling as provided in the DTI-DA-DOE JAO, and as reflected hereto.

The said amount shall be spent on the above-mentioned commodities commensurate to his/her personal and exclusive consumption and/or enjoyment within the calendar week, Provided, further that said amount shall be spent on at least four (4) kinds of items identified as BNPCs.”

Kaugnay nito, sadyang P65.00 lamang ang pinakamataas na halaga na maaaring ibawas sa halaga ng iyong pinamili sa grocery bilang diskwento kung naabot mo na ang lingguhang limitasyon o amount per calendar week na P1,300.00 halaga ng mga pinamiling basic necessities and prime commodities. Ang 5% ng P1,300.00 ay P65.00.

Gayon pa man, kung sadya namang hindi ibinigay sa iyo ang karampatang diskwento alinsunod sa nabanggit na mga panuntunan ay maaari kang maghain ng reklamo laban sa tao o establisimyento na lumabag sa batas.

Ang naturang reklamo ay maaaring ihain sa Office of the Senior Citizen Affairs ng lugar kung saan ka nakatira o kung saan matatagpuan ang establisimyento.

Maaaring mapatawan ng parusa na pagkakakulong at multa ang sinumang mapatunayang hindi tumalima sa batas at mga angkop na panuntunan nito. (Section 8, JMC No. 01, Series of 2022 in relation to Section 7, R.A. No. 9994).

Ang involuntary servitude o sapilitang pagtatrabaho ay hindi pinahihintulutan ng batas, alinsunod sa Article III ng Bill of Rights ng 1987 Constitution of the Philippines:

“Section 18. (2) No involuntary servitude in any form shall exist except as a punishment for a crime whereof the party shall have been duly convicted.”

Batay sa nabanggit na probisyon, hindi ka maaaring pilitin pang magtrabaho ng iyong boss. Gayunpaman, sinasabi ng batas na kung magre-resign sa trabaho ay kinakailangan ang hindi bababa sa isang buwan na advance notice – maliban kung may dahilan (ayon sa itinatadhana sa ilalim ng batas) na nagpapahintulot sa empleyado na magbitiw agad, o kung paikliin o i-waive ng employer ang nasabing one-month notice. Kung hindi ito susundin, maaaring pagbayarin ng danyos ang magre-resign na empleyado. Ito ay malinaw sa mga sumusunod na probisyon ng Labor Code of the Philippines:

“Art. 285. Termination by employee.

a. An employee may terminate without just cause the employee-employer relationship by serving a written notice on the employer at least one month in advance. The employer upon whom no such notice was served may hold the employee liable for damages.

b. An employee may put an end to the relationship without serving any notice on the employer for any of the following just causes:

1. Serious insult by the employer or his representative on the honor and person of the employee;

2. Inhuman and unbearable treatment accorded the employee by the employer or his representative;

3. Commission of a crime or offense by the employer or his representative against the person of the employee or any of the immediate members of his family;

4. Other causes analogous to any of the foregoing.”
