Tuloy ang imbestigasyon ng International Criminal Court (ICC) sa war on drugs ng Duterte administration.

Ito ay matapos ibasura ng Appeals Chamber ng ICC ang apela ng gobyerno ng Pilipinas na kumukontra sa nagpapatuloy na imbestigasyon sa drug war ng nakaraang administrasyon.

Mayorya ng mahistrado ang pabor na imbestigahan ang war on drugs, dalawa naman ang tutol, kasama ang presiding judge ng ICC Appeals Chamber na si Marc Perrin De Brimchambaut.

Hindi tinanggap ng chamber ang argumento ng Pilipinas na nagkamali ang ICC dahil wala nang hurisdiksyon dito ang International Court mula nang kumalas ang Pilipinas sa Rome Statute.

Nagkamali rin umano ang Pilipinas nang hindi nito inilatag nang maayos at natalakay nang sapat ang isyu sa Pre-Trial Chamber. Kasama rin sa ibinasura ng chamber ang argumento ng Pilipinas na nagkaroon din ito ng mga imbestigasyon at prosekusyon sa Pilipinas laban sa mga sangkot sa war on drugs.

Tatayo bilang legal counsel ni Senador Ronald “Bato” dela Rosa si Sen. Francis Tolentino para kumatawan kaugnay sa imbestigasyon ng International Criminal Court (ICC) hinggil sa war on drugs noong administrasyon ni dating Pangulong Rodrigo Duterte.

“I accept the proposal of Sen. Dela Rosa to lawyer for him,” ani Tolentino, chairperson ng Senate committee on justice and human rights, sa online news conference kahapon kaugnay sa hiling ni Dela Rosa, na dating chief ng Philippine National Police na nahaharap sa kasong crimes against humanity.

Nanindigan din si Tolentino na dapat dito sa Pilipinas gawin ang imbestigasyon at hindi sa Netherlands.

Kaugnay nito, hindi pa rin umano niya nakakausap si Duterte hinggil sa posibleng kinatawan ng huli sa international tribunal.

"If he wants, I’m just having my papers fixed now for my proper accreditation if that will come to that point,” aniya pa.

“My role would be to ensure the protection of Sen. Dela Rosa, not just within the confines of the ICC. Because we’re claiming that they do not have jurisdiction, but even locally,” wika pa ni Tolentino.

Matatandaang pumasa si Tolentino sa Philippine Bar Exams noong taong 1984 at New York State Bar Exams noong 1991.

Wala na umanong gagawing hakbang ang gobyerno ng Pilipinas makaraang ibasura ng International Criminal Court (ICC) ang apela ng Pilipinas na suspendihin ang imbestigasyon sa anti-drug war campaign ni dating Pangulong Rodrigo Duterte.

Ayon kay Marcos, dahil sa pagkabasura ng apela ay wala nang dahilan para makisangkot pa ang Pilipinas sa ICC.

"We don't have next move. That's the extent of our involvement with the ICC. That ends our involvement with the ICC," sabi ni Marcos sa isang panayam sa Pasay City.

"The appeal has failed. In our view, there’s nothing more that we can do... At this point we are essentially disengaging from any contact, communication with the ICC," saad ng Pangulo.

Binigyang-diin ni Marcos na wala nang anumang recourse ang Pilipinas sa ICC kung saan pinananatili ang posisyon ng gobyerno na hindi ito makikipagtulungan sa international body.

"We ended up in the same position that we started with and that is we cannot cooperate with the ICC considering the very serious questions about their jurisdiction and about what we consider to be interference and practically attacks on the sovereignty of the Republic," paliwanag niya.

"So that pretty much it, we have no longer any recourse when it comes to the ICC," dagdag pa ng Pangulo.
