Dear Chief Acosta,
Katatapos lamang ipagdiwang ng aking kapatid ang kanyang ika-18 taong kaarawan. Bagaman nanghihinayang kami pareho na hindi siya nakalahok sa katatapos lamang na botohan ay sisiguraduhin naming magkapatid na makapagparehistro siya upang makaboto sa darating na eleksyon.
Ang concern lamang po namin ay may kapansanan o person with disability (PWD) ang kapatid ko. Maaari pa rin po ba siyang makaboto? Ipinagbabawal po ba sa batas ang pagboto ng may kapansanan? Sana ay maliwanagan n'yo ako.

Dear Ariane,
Ang paglahok sa eleksyon sa pamamagitan ng pagboto ng mga mamumuno sa bawat lokalidad at maging sa buong bansa ay isa sa mga karapatan na ginagarantiyahan ng ating Saligang Batas. Nais naming bigyang-diin na walang rekisito ukol sa pisikal o mental na kondisyon ang kinakailangan upang magamit ng isang Pilipino ang kanyang karapatan na bumoto. Malinaw na nakasaad sa Section 1, Article V ng ating 1987 Philippine Constitution na:
“Section 1. Suffrage may be exercised by all citizens of the Philippines, not otherwise disqualified by law, who are at least eighteen years of age, and who shall have resided in the Philippines for at least one year and in the place wherein they propose to vote, for at least six months immediately preceding the election. No literacy, property, or other substantive requirement shall be imposed on the exercise of suffrage.” (Binigyang-diin)
Kaugnay nito, masasabing hindi balakid ang pagkakaroon ng kapansanan ng iyong kapatid upang siya ay bumoto sa susunod na halalan. Ang mahalaga lamang ay nasa edad 18 taon pataas na siya, nakatira sa Pilipinas nang hindi bababa sa isang (1) taon at wala siyang ibang diskwalipikasyon alinsunod sa batas.
Magiging mainam na alalayan n'yo siya, kung kinakailangan niya ng tulong, upang siya ay makapagparehistro bilang botante nang sa ganoon ay mayroon siyang personal na kilala na gagabay sa kanya sa prosesong ito. Kung hindi man kayo makakasama ay mayroon pa rin namang ibang maaaring gumabay sa kanya sapagkat malinaw na nakasaad sa Sections 7 at 8 ng Republic Act (R. A.) No. 10366:
“Section 7. Assistance in the Accomplishment of Application Form. – A person with disability or senior citizen who cannot by himself or herself accomplish an application for registration, by reason of illiteracy or physical disability, shall be assisted by the Election Officer in the preparation of his or her application form, or by any member of an accredited citizens’ arm, or by a relative by consanguinity or affinity within the fourth civil degree, or if he or she has none present, by any person of his or her confidence who belongs to the same household.
Section 8. Satellite and Special Registration. – The Commission, in coordination with national government agencies and local government units, person with disability and senior citizen organizations, and other cause-oriented groups, shall conduct satellite and/or special registration for persons with disabilities and senior citizens in accessible places.”
Gayon din, maaari siyang alalayan sa araw mismo ng pagboto kung kakailanganin niya ng angkop na tulong. Batay sa Section 11 ng R. A. No. 10366:
“Section 11. Assistance in the Accomplishment of the Ballot. – A person with disability or senior citizen who is illiterate or physically unable to prepare the ballot by himself or herself may be assisted in the preparation of his or her ballot by a relative by consanguinity or affinity within the fourth civil degree, or if he or she has none, by any person of his or her confidence who belongs to the same household, or by any member of the BEls. For this purpose, the person who usually assists the person with disability or senior citizen, such as a personal assistant, a caregiver or a nurse shall be considered a member of his or her household:
Provided, That no voter shall be allowed to have an assistor on the basis of illiteracy or physical disability unless it is so indicated in his or her registration record. Nevertheless, if the physical inability to prepare the ballot is manifest, obvious, or visible, said voter shall be allowed to be assisted in accomplishing the ballot by a qualified assistor, even if not stated or indicated in the registration record: Provided, further, That the assistor must be of voting age. x x x”
