Ipinauubaya na ng Department of Labor and Employment (DOLE) sa mga employer kung ipagpapatuloy ang work-from-home arrangement ng kanilang mga empleyado sa kabila ng COVID-19 pandemic.


Ito ay ipinahayag ni Labor Secretary Silvestre Bello III matapos magdesisyon ang national government na luwagan ang quarantine classification ng Metro Manila sa Alert Level 2.


“Yung employer sasabihin kailangan ko na mag-report na kayo dahil maluwag naman mga health protocols. Palagay ko naman magkakaintindihan mga empleyado,” ani Bello sa isang panayam.


Ayon naman kay Sergio Ortiz-Luis ng Employers’ Federation of the Philippines, posibleng hindi papasukin ng mga employers ang kanilang mga empleyado dahil pa rin sa issue sa transportasyon.


“Marami riyan hindi pa rin papasukin ‘yung mga tao dahil ang may kulang hindi sila. Ang may pagkukulang ay itong nasa transportasyon,” ani Ortiz-Luis.


“Lalo sa opisina na pinaglayu-layo mo yung ano, 50% lang, edi ganun work-from-home ‘yung iba. Papasukin mo ngayon, Paano ‘yun? Maglalaki ng opisina?” dagdag niya.

Ipinahayag ng Department of Justice (DOJ) ngayong Huwebes na nilinaw nila sa Inter-Agency Task Force (IATF) ang isyu na ang mga empleyado ay hindi required o kinakailangan at piliting magpabakuna kontra-COVID-19.


“I emphasized that the COVID-19 vaccination program act of 2021 was clear on the non-compulsory nature of vaccination as an additional requirement for employment,” ani Justice chief Menardo Guevarra sa isang mensahe sa mga reporter.


“Unless amended or modified by Congress, it is the existing and applicable law,” dagdag ni Guevarra.


Ayon kay Guevarra, ibinatay lamang ito ng Department of Labor and Employment (DOLE) sa mga naging comments at nakatakda namang i-align o isaayos ang kanilang polisiya.


“Wala namang nag-express ng any different or contrary position among the IATF members. The DOLE duly noted our advice and stated that it will align its policy pronouncements accordingly,” paliwanag ni Guevarra.


Nag-isyu si Guevarra ng naturang remark, ilang araw matapos na sabihin ng DOLE na ang pag-terminate o pagtatanggal sa mga empleyado ay ipinagbabawal kung ang dahilan lamang nito na sila ay hindi bakunado.


Matatandaan namang sinabi ni DOLE Secretary Silvestre Bello III na mayroong legal basis para sa mga employer sa mga lugar na nasa ilalim ng Alert Level 3 na i-require ang kanilang mga empleyado na magpabakuna kontra-COVID-19.

Naglabas ang Department of Labor and Employment (DOLE) ng isang advisory hinggil sa pagbabayad sa mga manggagawa para sa All Saints’ Day ng Nobyembre 1, All Souls’ Day ng Nobyembre 2, at Bonifacio Day ng Nobyembre 30.


Nailathala noong Oktubre 26 na batay sa DOLE’s Labor Advisory No. 19-21, nakasaad ang mga sumusunod na pay rules para sa mga holiday ng Nobyembre:


All Saints’ Day – Nobyembre 1 (Special non-working day)

• if the employee did not work, the "no work no pay” policy shall apply unless there is a favorable company policy, practice, or collective bargaining agreement granting payment on a special holiday

• for work done during the special day, he/she shall be paid additional 30% of his her basic wage on the first eight hours of work [(basic wage x 130%) + COLA]

• for work done in excess of eight hours (overtime work), he/she shall be paid an additional 30% of his/her hourly hour rate on said day (hourly rate of the basic wage x 130% x 130% x number of hours worked)

• for work done during a special day that also falls on his/her rest day, he/she shall be paid an additional 50% of his/her basic wage on the first eight hours [(basic wage x 150%) + COLA]

• for work done in excess of eight hours (overtime work) during a special day that also falls on his/her rest day , he/she shall be paid an additional 30% of his/her hourly rate on said day (hourly rate of the basic wage x 150% x 130% x number of hours worked)


All Souls’ Day – Nobyembre 2 (Special working day)

• For work performed on a declared special working day, an employee is entitled only to his/her daily wage. No premium pay is required since work performed on said day is considered work on an ordinary day.


Bonifacio Day – Nobyembre 30 (Regular holiday)

• if the employee did not work, he/she shall be paid 100% of his/her wage for that day, subject to certain requirements under the implementing rules and regulations of the Labor Code, as amended [(basic wage + COLE) x 100%]

• for work done during the regular holiday, the employee shall be paid a total of 200% of his/her wage for that day for the first eight hours [(basic wage + COLA) x 200%] • for work done in excess of eight hours (overtime work), he/she shall be paid an additional 30% of his/her hourly rate on said day [hourly rate of the basic wage x 200% x 130% x number of hours worked]

• for work done during a regular holiday that also falls on his her rest day, he/she shall be paid an additional 30% of his/her basic wage of 200% [(basic wage + COLA) x 200] + [30% (basic wage x 200%)]

• for work done in excess of eight hours (overtime work) during a regular holiday that also falls on his/her rest day, he/ she shall be paid an additional 30% of his/her hourly rate on said day (hourly rate of the basic wage x 200% x 130% x 130x number of hours worked)


Gayunman, dahil sumailalim ang bansa sa national emergency sanhi ng COVID-19, ayon sa DOLE ang mga establisimyento na totally closed or ceased operation o tuluyang nagsarado sa panahon ng community quarantine ay exempted naman mula sa pagbabayad ng holiday pay ng Nobyembre 30 sa ilalim ng advisory.
