Dear Mitzel,


Tinalakay ng Kagalang-galang na Korte Suprema sa kasong Dinna Castillo vs. Zenaida C. Buencillo (A.M. No. P-97-1241, 20 March 2001, Ponente: Honorable Associate Justice Jose Armando R. Melo) na ang paluwagan ay isang pamamaraan kung saan ang mga miyembro ay sumang-ayon na ilagay ang kanilang pera sa isang karaniwang pondo.


Bawat isa sa kanila ay tumatanggap ng “payout” na katumbas sa kabuuang halaga na nakolekta mula sa lahat ng mga miyembro, sa isang partikular na panahon at sa isang tinukoy na oras. Ito ay itinalaga bilang kanilang partikular na iskedyul upang makatanggap ng nakolektang pondo:


“Paluwagan is not a form of gambling or lottery. It is not a game of chance where one wins while the others lose; it is a scheme where the members agree to put their money in a common fund, each one of them receiving the total amount collected from all the members for a given period at a specified time designated as their particular schedule to receive the same (Evaluation of the Office of the Court Administrator, August 17, 2000, p. 11). It does not involve wagering, gambling, or betting penalized under the Revised Penal Code (Record, p. 112). Respondent did not violate any law in engaging in paluwagan.”


Kaayon nito, sa kasong Samuel Barangan vs. Court of Appeals and Leovino Jose (G.R. No. 123307, 29 November 1999, Ponente: Honorable Associate Justice Josue N. Bellosillo), pinasyahan ng Kagalang-galang na Korte Suprema na ang paluwagan, bilang isang trust fund kung saan ang mga miyembro nito ay maaaring kumuha ng pera kung sakaling kailanganin, ay hindi labag sa batas:


“It has been proven time and again that schemes such as in the instant case — innocuously denominated as a paluwagan — are but rackets designed to victimize the gullible public. We want to clarify, however, that a paluwagan, which operates as a trust fund from which members can draw money in case of need, is not illegal per se. But if it becomes a device to entice investments, usually with the promise of enormous dividends, when in truth the ultimate objective is to swindle the investors, then the scheme is transformed into an illegal activity. x x x”


Gayunpaman, kung ito ay magiging isang kasangkapan upang maakit ang mga mamumuhunan, kadalasang may pangako ng napakalaking dibidendo ngunit ang tunay na layunin ay linlangin ang mga namumuhunan, ang diumanong paluwagan ay magiging isang ilegal na aktibidad.


Kaya naman, dapat mo munang imbestigahan kung ang nasabing aktibidad ng iyong katrabaho ay tunay bang isang paluwagan o baka ito ay isang pamamaraan ng panlilinlang sa kapwa.

Dear Chief Acosta,


Noong Hulyo 2019, ako ay bumili ng bahay at lupa mula sa isang developer na kung saan ang aking monthly amortization ay nagkakahalaga ng Php 15,000.00. Ako ay naghuhulog sa kanya sa nakalipas na apat na taon, bagama’t hindi ito tuluy-tuloy sapagkat ilang buwan akong hindi nakapaghulog noong nakaraang taon dahil nawalan ako ng trabaho. Ang kabuuang halaga ng aking naibayad ay Php 270,000.00.


Ngayon ay nawalan muli ako ng trabaho at hindi ko na kakayanin pa na magbayad.


Maaari ba akong makakuha ng refund mula sa developer ng binili kong bahay at lupa? - Laurice


Dear Laurice,


Ang batas na sasaklaw patungkol sa iyong katanungan ay ang Republic Act 6552, o mas kilala bilang Realty Installment Buyer Act o Maceda Law. Nakasaad sa Section 3 ng nasabing batas:


“Section 3. In all transactions or contracts involving the sale or financing of real estate on installment payments, including residential condominium apartments but excluding industrial lots, commercial buildings and sales to tenants under Republic Act Numbered Thirty-eight hundred forty-four, as amended by Republic Act Numbered Sixty-three hundred eighty-nine, where the buyer has paid at least two years of installments, the buyer is entitled to the following rights in case he defaults in the payment of succeeding installments:


a. To pay, without additional interest, the unpaid installments due within the total grace period earned by him which is hereby fixed at the rate of one month grace period for every one year of installment payments made: Provided, That this right shall be exercised by the buyer only once in every five years of the life of the contract and its extensions, if any.

b. If the contract is canceled, the seller shall refund to the buyer the cash surrender value of the payments on the property equivalent to fifty per cent of the total payments made, and, after five years of installments, an additional five per cent every year but not to exceed ninety per cent of the total payments made: Provided, That the actual cancellation of the contract shall take place after thirty days from receipt by the buyer of the notice of cancellation or the demand for rescission of the contract by a notarial act and upon full payment of the cash surrender value to the buyer.


Down payments, deposits or options on the contract shall be included in the computation of the total number of installment payments made.”

Kaugnay nito, sinabi ng Korte Suprema sa kasong Orbe v. Filinvest Land (G.R. No. 208185, 06 September 2017, Ponente: Honorable Associate Justice Marvic M.V.F. Leonen) na:


The phrase “at least two years of installments” refers to value and time. It does not only refer to the period when the buyer has been making payments, with total disregard for the value that the buyer has actually conveyed.”


Samakatuwid, ang isang mamimili na nakapagbayad nang hindi bababa sa halagang katumbas ng dalawang taong installments ay dapat bigyan ng grace period na itinalaga ng batas. Kung sakaling hindi pa rin makapagbayad sa loob ng itinakdang grace period at ang kontrata ay nakansela na, siya ay may karapatan sa cash surrender value ng kanyang naibayad alinsunod pa rin sa nasabing batas. Ayon sa Korte Suprema, ang mga katagang “at least two years of installments” ay hindi lamang tumutukoy sa haba ng panahon ng pagbabayad. Ito rin ay tumutukoy sa halagang naibayad.


Sa iyong sitwasyon, ang katumbas ng dalawang taong buwanang installment ay nagkakahalaga ng Php 360,000.00. Bagama’t ikaw ay nakapagbayad sa loob ng mahigit na dalawang taon, ang kabuuang halaga na iyong ibinayad ay Php 270,000.00 lamang.


Dahil dito, hindi ka maaaring mag-demand ng refund. Ang probisyon sa Section 4 ng nabanggit na batas ang siyang gagabay sa iyong sitwasyon na kung saan ikaw ay mabibigyan lamang ng grace period upang magbayad, at hindi ang karapatang makakuha ng refund.

Ang pamilya namin ay isa sa mga benepisyaryo ng 4Ps. Hirap kaming matugunan ang aming mga buwanang obligasyon tulad ng bill sa kuryente. Nabanggit sa akin ng aming kapitbahay na mayroon diumanong ibinibigay na subsidy/diskwento sa singil sa kuryente. Totoo ba ito? - Verlyn


Dear Verlyn,


Para sa iyong kaalaman, ang batas na nakasasaklaw sa iyong katanungan ay ang Republic Act (R.A.) No. 9136, na inamyendahan ng R.A. No. 11552, na siyang nagbibigay ng ekstensyon sa tinatawag na lifeline rate. Ang lifeline rate ay isang subsidiya sa singil sa kuryente na ibinibigay para sa mga nasa laylayan ng ating lipunan. Ayon dito:


“Sec. 73. Lifeline Rate. – In order to provide assistance to electricity consumers, especially those living below the poverty line, and to achieve a more equitable distribution of the lifeline subsidy a socialized pricing mechanism called a lifeline rate for qualified marginalized end-users shall be set by the ERC which shall be exempted from the cross subsidy phase-out under this Act for a period of fifty (50) years, unless otherwise extended by law. The level of consumption, subsidy, and rate shall be determined by the ERC after due notice and hearing: Provided, That the ERC shall primarily utilize data from the Philippine Statistics Authority (PSA) in the determination of the level of consumption.


Qualified marginalized end-users shall refer to any of the following:


(a) Qualified household-beneficiaries under Republic Act No. 11310, otherwise known as the ‘Pantawid Pamilyang Pilipino Program (4Ps) Act,’ as regularly submitted by the Department of Social Welfare and Development (DSWD) to the DOE, the ERC, and the distribution utility, whose level of consumption shall be within the threshold determined by the ERC, are qualified marginalized end-users under this Act;


(b) Marginalized end-users who have been certified and continually validated as such by their distribution utility based on a criteria determined by the ERC: Provided, That the criteria shall take into account, among others, the poverty threshold set by the PSA, and shall contain an exclusive list of requirements to be submitted to the distribution utility: Provided, further, That the exclusive list of requirements shall be simplified and reasonable for the applicant: Provided, furthermore, That the distribution utility shall act on the application for certification as a marginalized end-user within two (2) working days from submission of complete documentary requirements: x x x.


All qualified marginalized end-users shall continually meet the criteria in this Act to avail of the lifeline rate.”


Ayon sa nabanggit na batas, ang lifeline/subsidized rate ay ibinibigay sa mga qualified marginalized end-users – tulad ng (a) benepisyaryo ng 4Ps batay sa talaan ng Department of Social Welfare and Development (DSWD), at (b) ang mga konsyumer na nabubuhay below the poverty threshold, na sertipikado ng DSWD – bilang bahagi ng mekanismo ng socialized pricing, na nagbibigay ng porsyentong diskwento alinsunod sa mga alituntuning itinakda ng Energy Regulatory Commission (ERC). Ang lifeline rate ay isang non-cash monetary discount na ibabawas ng distribution utility (tulad ng Manila Electric Company o MERALCO), depende sa aktuwal na konsumo, sa buwanang singil sa kuryente ng mga qualified marginalized end-users.


Kaugnay nito, alinsunod sa Joint Resolution No. 01, Series of 2022 na may petsang 28 Oktubre 2022 na inilabas ng Department of Energy (DOE), DSWD at ERC, para makapag-apply/avail para sa nasabing lifeline rate, ang kuwalipikadong konsyumer ay kailangan lang magrehistro sa provider ng kuryente/distribution utility, at magsumite ng mga sumusunod na dokumento:


i. duly-accomplished application form;

ii. pinakahuling bill ng kuryente;

iii. valid government-issued ID na may pirma at tirahan ng konsyumer;

iv. certification mula sa local social welfare and development office, na nagpapakita na ang kita ay below the poverty threshold.
