Naipundar na bahay ng mag-asawa, bawal ilipat sa pangalan ng kabit

Dear Chief Acosta,
Mayroon nang kinakasamang iba ang tita ko kahit hindi pa sila legal na hiwalay ng tito ko. Bali-balita sa aming lugar na plano niyang ilipat ang pangalan ng bahay at lupa na naipundar nila ng tito ko noong nagsasama pa sila sa kanyang kinakasama. Legal ba niyang magagawa ito? - Chuchie

 

Dear Chuchie,
Pinahahalagahan ng ating batas ang pagsasama ng mag-asawa. Maliban sa mga kaakibat na obligasyon sa pagitan nila, mayroon ding limitasyong itinatakda ang ating batas sa mga maaaring gawin ng mag-asawa. Ang isa na rito ay ang pagbebenta, pamimigay at/o anumang uri ng pagdi-dispose ng ari-arian na naipundar nila. Magagawa lamang ang alinman sa mga akto na nabanggit kung kapwa mayroong pahintulot ng mag-asawa o kung ito ay inotorisa ng hukuman. Batay sa Articles 96 at 98 ng Family Code of the Philippines:


“Art. 96. The administration and enjoyment of the community property shall belong to both spouses jointly. In case of disagreement, the husband’s decision shall prevail, subject to recourse to the court by the wife for proper remedy, which must be availed of within five years from the date of the contract implementing such decision.


In the event that one spouse is incapacitated or otherwise unable to participate in the administration of the common properties, the other spouse may assume sole powers of administration. These powers do not include disposition or encumbrance without authority of the court or the written consent of the other spouse. In the absence of such authority or consent, the disposition or encumbrance shall be void. However, the transaction shall be construed as a continuing offer on the part of the consenting spouse and the third person, and may be perfected as a binding contract upon the acceptance by the other spouse or authorization by the court before the offer is withdrawn by either or both offerors.


Art. 98. Neither spouse may donate any community property without the consent of the other. However, either spouse may, without the consent of the other, make moderate donations from the community property for charity or on occasions of family rejoicing or family distress.” (Binigyang-diin)


Subalit, hindi ganap na maililipat ang anumang ari-arian na bahagi ng ari-arian ng mag-asawa sa kinakasama nila. Alinsunod sa Article 739 ng ating New Civil Code: “The following donations shall be void: (1) Those made between persons who were guilty of adultery or concubinage at the time of the donation; x x x” 


Kaugnay nito, maaari lamang legal na mailipat ng iyong tiyahin sa pangalan ng iba ang bahay at lupa na naipundar nila ng tiyuhin mo kung ito ay mayroong pahintulot ng iyong tiyuhin. Gayunman, hindi niya maaaring ilipat sa pangalan ng kanyang kinakasama ang naturang ari-arian dahil hindi lamang nililimitahan, bagkus ay ipinagbabawal pa ng batas ang ganu’ng uri ng pagsasalin o paglilipat.


Nawa ay nasagot namin ang inyong katanungan. Nais naming ipaalala sa inyo na ang opinyong ito ay nakabase sa inyong mga naisalaysay sa inyong liham at sa pagkakaintindi namin dito. Maaaring maiba ang opinyon kung mayroong karagdagang impormasyong ibibigay. Mas mainam kung personal kayong sasangguni sa abogado.
