Nawalang birth certificate dahil sa kalamidad, i-request sa Bgy. para makahingi ng kopya

          Ano ang maaari kong gawin upang magkaroon ng bagong kopya ng birth certificate ng anak ko na nasira dahil sa kalamidad? — Helena

 

Dear Helena,
          Para sa inyong kaalaman, ang Republic Act No. 10821 o ang “Children’s Emergency Relief and Protection Act” ay angkop sa inyong katanungan. Ayon sa sumusunod na probisyon ng Implementing Rules and Regulations (IRR) ng nasabing batas:

 

“Rule 14. System of Restoring and Reconstructing Civil Registry Documents. xxx

 

Section 1. Restoration or Reconstruction of Lost or Destroyed Civil Registry Documents.

 

a. Roles of Barangay and Local Civil Registrar. Requests for restoration and reconstruction shall be submitted to the barangay, through the BDRRMC, where the child is residing at the time of the disaster. The barangay shall forward all eligible requests to the local civil registrar within (3) days from the acceptance of said request.

 

The local civil registrar shall provide the necessary application forms for the restoration or reconstruction of civil registry documents to all disaster-affected barangays. It shall also designate focal personnel to assist said barangays in the processing of requests during the early recovery phase of the disaster.

 

In case the local civil registrar cannot function as a result of the disaster, the regional office of the PSA shall assume the abovementioned tasks.”

 

Sang-ayon sa nasabing batas, kayo ay maaaring magsumite ng request para sa restoration o reconstruction ng birth certificate ng inyong anak sa barangay, sa pamamagitan ng Barangay Disaster Risk Reduction and Management Council (BDRRMC).

 

Ipadadala ng barangay ang inyong request sa local civil registrar para sa pagproseso nito. Mayroong mga alituntunin na kailangan ninyong sundin tulad ng accomplishment ng application form at pagbibigay ng government-issued identification card ng inyong anak o sa kawalan nito ay ibang dokumento na itinuturing na acceptable evidence of identity na nakasaad sa Section 1 (c) ng IRR tulad ng baptismal certificate, school forms and/or student ID card containing the Learner Residence Number (LRN) or other school record bearing the name and other personal circumstances of the child. 

 

Nawa ay nasagot namin ang inyong katanungan. Nais naming ipaalala sa inyo na ang opinyong ito ay nakabase sa inyong mga naisalaysay sa inyong liham at sa pagkakaintindi namin dito. Maaaring maiba ang opinyon kung mayroong karagdagang impormasyong ibibigay. Mas mainam kung personal kayong sasangguni sa abogado.
