Hindi pa maaaring igiit ang execution ng desisyon kapag mayroong Motion for Reconsideration ang kala

Dear Chief Acosta,

Nanalo ako sa aking kaso laban sa franchisor ko na nanloko sa akin. Ngayon, nais ko sanang ma-execute na ang aking pagkapanalo. Sa kasamaang-palad, nag-Motion for Reconsideration ang aking kalaban at naabutan pa ng lockdown. Kaya naman, nais kong malinawan kung maaari ko mapa-execute ang aking pagkapanalo. Sa pagkakaalala ko, sabi ng dati kong abogado, apela lang ang magpapatagal sa aking kaso. Dahil sa hindi naman apela ang ginawa ng aking kalaban kundi Motion for Reconsideration, maaari ko na bang igiit ang execution ng aking panalo? Gilyn

Dear Gilyn,

Ang sagot sa inyong katanungan ay hindi pa po. Nakasaad sa ating Rules of Court na ang desisyon ay maaari lamang ma-execute sa dalawang (2) pamamaraan. Una, kapag ang kaso ay naging “final and executory” at ang execution ay sinasabing “as a matter of right.” Pangalawa, kapag naman “pending appeal” kung saan tinatawag naman na “discretionary.”

Sa inyong nabanggit na sitwasyon, masasabi nating hindi pa “a matter of right” ang pag- execute ng desisyon sapagkat hindi pa naman pinal ang kaso dahil hindi pa natatapos ang panahon sa pag-apela ng inyong kalaban. Sa kabilang banda, hindi rin ito isang sitwasyon kung saan maaari nang gamitin ang discretionary execution, yamang hindi pa nagsisimula ang period to appeal ng inyong kalaban gawa ng kanilang Motion for Reconsideration sa korte.

Sa katunayan, sinabi ng Korte Suprema sa kasong JP Latex Technology, Inc. vs. Balloons Granger Balloons, Inc. (G.R. No. 177121, March 16, 2009), isinulat ni Honorable former Associate Justice Dante O. Tiñga, na kapag mayroong nakabinbin pang Motion for Reconsideration hindi pa maaari i-execute ang desisyon, viz:

“That being the case, the pendency of the motion for reconsideration has prevented the period to appeal from even commencing. The period within which a party may move for an execution pending appeal of the trial court’s decision has not yet also started.

Where there is a pending motion for reconsideration of the RTC decision, an order execution pending appeal is improper and premature. The pendency of the motion for reconsideration legally precludes execution of the RTC decision because the motion serves as the movant’s vehicle to point out the findings and conclusions of the decision which, in his view, are not supported by law or the evidence and, therefore, gives the trial judge the occasion to reverse himself. In the event that the trial judge finds the motion for reconsideration meritorious, he can of course reverse the decision.

In the absence of an appeal from the decision, as the motion for reconsideration is still unresolved, the execution ordered by the RTC cannot be properly considered as execution pending appeal.” (Binigyang-diin)

Nawa ay nasagot namin ang inyong mga katanungan. Nais naming ipaalala sa inyo na ang opinyong ito ay nakabase sa inyong mga naisalaysay sa inyong liham at sa pagkakaintindi namin dito. Maaaring maiba ang opinyon kung mayroong karagdagang impormasyon na ibibigay. Mas mainam kung personal kayong sasangguni sa abogado.
